“Responding to former Gov. Rod Blagojevich’s motion to dismiss his June conviction on public corruption charges, federal prosecutors in a filing late Monday rejected allegations of bias, saying trial decisions were focused on facts and evidence relevant to the charges.
Blagojevich filed a 158-page motion in late July, saying his case should be dismissed because of alleged widespread judicial and prosecutorial bias against him.
“In reality, there was no bias, manipulation, or unfairness on the part of the prosecution, judge or jury. Defendant was fairly convicted by a jury of his peers based on overwhelming evidence, and his post-trial motions therefore should be denied,” prosecutors said in their filing.
U.S. District Court Judge James Zagel, the judge at trial, will eventually rule on whether to dismiss the case. While that outcome would appear highly unlikely, the defense filing offered a glimpse of the likely issues that Blagojevich’s lawyers will target in an eventual appeal with a federal appellate court.
A federal jury convicted Blagojevich in June on 17 of 20 wire fraud, bribery, attempted extortion and conspiracy counts, including allegations he tried to sell the U.S. Senate seat left open by Barack Obama’s election to president in 2008.
The former governor was also convicted at his first trial last summer on a single count of lying to the FBI. The jury, however, deadlocked on all the other counts, setting the stage for the retrial. Blagojevich is set to be sentenced Oct. 6.
The government, in the 133-page motion, dealt with some of the more headline-grabbing allegations made by the defense, including the idea that there were missing phone calls amid the numerous wiretaps the government presented as evidence during the trial.
One of those calls involving former Blagojevich chief of staff John Harris, the government said, was simply not recorded and therefore not available.
“The likely reasons why the call was not intercepted are that Harris took the call on a non-wiretapped phone line, or that the call took place during a time his phone line was not being monitored,” the motion reads. “As the records provided to the defense make clear, there was no break in the wiretaps and no deletion of recordings that would account for this call not being recorded,” the government said of one of the calls.”

“In a stark reversal, the Obama administration announced Monday that it would resume military tribunals for suspected terrorists held at Guantanamo Bay. President Obama had ordered the prison be shut down on his second day at the White House and the announcement effectively amounted to an acknowledgment that the administration reached an impasse in its efforts to transfer some prisoners to the United States and prosecute them in federal court.
Although administration officials insist the president is still committed to closing down the prison, he signed an executive order Monday that for the first time laid out the administration’s legal strategy to keep prisoners incarcerated indefinitely without trial.
The executive order applies to “at least 48 of the 172 detainees” who are still in Guantanamo and Justice Department lawyers determined “could not be prosecuted in military commissions or in federal court because evidentiary problems would hamper a trial,” reports the Washington Post. Administration officials took pains to insist Obama’s executive order adds due-process rights that weren’t there under his predecessor, notes the Wall Street Journal. Within a year, each of the 48 detainees should receive an unclassified review detailing why they are to remain behind bars.
Each detainee’s case will be fully reviewed every three years with interim reviews every six months to evaluate any new information. One attorney who represents 20 detainees tells the Washington Post “he sees no substantive difference between the new system and the review process under the George W. Bush administration.”
The administration has not said anything about its plans for trying the men accused of plotting the Sept. 11 attacks.

A new poll out of Iowa finds that Rick Perry is the new favorite there, not Michele Bachmann, the big winner of the state’s recent straw poll.
And support in Iowa for Texas congressman and libertarian Ron Paul appears to be surging.
Asked who they would support for president if the vote were held today, 22% of the Republican voters polled picked Mr. Perry, the Texas governor, compared with 19% for former Massachusetts Gov. Mitt Romney and 18% for Mrs. Bachmann, the Minnesota congresswoman. Rep. Paul came in fourth with 16% support, double his tally in PPP’s June poll. The numbers don’t change all that much if Ms. Palin is inserted into the mix. She comes in fifth, with just 10% support.

(Aug. 23, 2011) — The facts are now so obvious and blatant that even dyed-in-the-wool Obama sycophants should be able to see and hear the truth. What took the people of this country generations of their blood, toil and sweat to accomplish and build has been destroyed in less than four years. The United States of America has been gutted of its financial resources, its people have had their rights to makes their own decisions about their lives (think ObamaCare, the First, Second and Fourth Amendments for starters) rescinded so that Obama and his cabal will decide for them, US citizens have had their jobs removed and so thoroughly decimated that they must now rely on the fewer and fewer still working and Obama’s good will (an oxymoron if I ever heard one) to survive. And now Obama has decided–as he promised to do but, the leftist elite and enough mentally deficient American voters chose to elect him anyway–to shut down coal (even the refurbished “clean coal” plants) production operations by using his EPA regulation hammer to drive them out of business. Remember that Obama couldn’t get his Cap & Trade through Congress, so he issued a dictatorial fiat. This is completely illegal and unconstitutional but…no one is stopping him.
