“California attorney Orly Taitz today secured an order from United States District Court Magistrate Judge Richard L. Puglisi demanding representatives of the Hawaii Department of Health appear in federal court Sept. 14 to show why Taitz should be prevented from seeing whatever original 1961 documents the agency has on record regarding Barack Obama’s birth.
Taitz returned to federal court in Honolulu today after Hawaii DOH officials presented her with a letter refusing to comply with her subpoena on grounds that Hawaii privacy laws prevented officials from releasing Obama birth records to the public.
“It’s ridiculous,” Taitz told WND.
She had argued previously – without getting a response from the state – that Obama had waived all privacy rights by releasing his long-form birth certificate to the American public at a White House press conference April 27.

The ExParte Emergency Motion for Order to Show Cause and to Compel Attendance for Production of Documents that Taitz filed with the federal magistrate asked the court to demand Hawaii DOH head Loretta Fuddy appear in court to explain why she would not comply with the subpoena.
“Getting a federal judge to demand Fuddy’s attendance at a show-cause hearing is a victory,” Taitz said. “I will return to Hawaii on Sept. 14 and I expect then to be able to force the Hawaii DOH to turn over the relevant records as demanded by the subpoena.”
Taitz arrived in Hawaii Sunday evening to present the subpoena in person at the Hawaii DOH offices in Honolulu at 10 a.m. today.”

Hopefully Orly will see the merit in drawing Soetoro out on a limb. If he is not quick enough to see what she is doing,then she will have plenty of time to saw off the limb. There is absolutely NO WAY that someone carrying a supeona from a federal court would be denied access to see my birth records, even if I didn’t want them to. Further, a judge in Alaska has already ruled that political officials don’t have right to privacy.

The State of Hawaii DoH has refused a federal supeona to allow examination of records that are already in the public domain, violating their own rules and procedures to protect Obama’s identity and social security fraud.

I just read in the Charlotte Observer this morning where a man had been sentenced to 11 years in prison for idenity theft. He was stealing disabled verteran’s social security information and filing false tax return claims for money….in my opinion, he deserved more time than that.

There is a strategy behind the issuance of the subpoena from the FEDERAL COURT to HDOH. Orly anticipated the denial. She then went to FEDERAL COURT in Honolulu to compel.
So the judge in FEDERAL COURT in HI has set Sept. 14th as date for the HDOH to show cause. IF Orly is denied access to the original long form at HDOH as a result of this hearing, guess where she is going next.
The 9th Circuit Court of Appeals (yes, Hawaii is under that court’s jurisdiction). Orly still has a case pending at the 9th Circuit Court of Appeals.

OT…….. but at our Tea Party meeting last night we learned that many colleges in the US are offering Homeland Security classes on how to ‘disarm’ American citizens. Also, Bill Clinton already made a treaty with the UN in the case of civil unrest. UN troops will be allowed and welcomed on American soil. I’m guessing many of us didn’t know this law existed. I didn’t. So if anyone thought that it would be our own military or police preventing American citizens from pushing back against this tyranny, well it won’t be. I suppose there may be some, but most will be foreign troops and a bunch of indoctrinated college kids who have been trained to take down their own countrymen. They won’t have any problem hurting or killing anyone who resists.
Is it just me or do you all feel that Obama already has his ‘army’ that he talked about on the campaign trail? My guess is SEIU, ACORN, ILLEGAL or some FOREIGN, possibly MUSLIMs already here in the states will do his dirty deeds when the time comes, as well as those being trained in colleges on how to disarm America. I remember soon after Obama took office, he demanded that Northcom increase their numbers to a million, or something like that. In my opinion, most of this ‘army’ were already in place and waiting before Obama won the election. It’s also my opinion that all these riots popping up all over the world are being orchestrated. Civil unrest is needed in order to put martial law in place and basically, render our Constitution (in what few places it’s still honored) null and void. Do I dare say that any future elections won’t happen either?
I have no doubts that IF Hillary would have won the election, the same tactics to control the population would still have been used. One only has to do a little research on the Clintons to know that they have been traitors to this country for a very long time. Bill gave our military secrets to the Chinese, was the biggest instrument in the Fannie Mae and Freddie Mac downfall (check it out), and both of them have been trying to get socialized health care as well major, major gun control on Americans for as long as they’ve been involved in politics. They are good friends with many of our enemies, including George Soros whose main desire is to take down this country financially as he has done in other countries. The best way to control the population is the have control of the money, health, food, media, etc., and they are almost there. We have no recourse since our Congress won’t stop them and the courts are also corrupt. I believe those honest judges (however many are left) are being threatened into complying with the regime, such as Carter, whom someone mentioned earlier.
We should have listened to George Washington when he said that “The price of freedom is eternal vigilance.” We weren’t watching when all this stuff was being put into place over the years and now it’s speeding at us, too late to apply the breaks or even attach the bayonets (figuratively speaking). Our children and grandchildren are being taught how to be good little socialists in schools. No morals, ethics, religion, patriotism, pride in accomplishments….just mind-numbed robots taught to follow orders and not question or even think for themselves.
Stepping off the soap box now. Sorry for the rant. It’s not been a good few years for any of us.

Brian Schatz signed a certification as a private citizen who was a member of a political party, and not as Lt. Gov. No present cause of action filed by anyone, could result in compelling the man to produce anything. (Now, things would be different if Mr. Schatz lived in TX, given the laws on the books in that state.)
If Hawaiians want to pursue election fraud, they must persuade their AG to do so. However, they cannot compel prosecution, as this is a discretionary function of the office.

A subpoena is NOT a court order, which would be signed by a judge. Orly didn’t have that yesterday. If the September 14 hearing results in Judge Puglisi granting Orly an Order to Compel, she will then be entitled to inspect or obtain a certified copy of Obama’s birth record, pending any appeal by the State of Hawaii.

What information do you think the hospital would have about a 50 year old birth certificate? Hospitals keep records for 7 years after discharge under federal law.
In Hawaii (and many other states) only the state issues official birth certificates;. The ones issued by hospitals are commemorative items only.
The law in Hawaii requires a COURT ORDER signed by a judge. A subpoena is not a court order. A search warrant or an arrest warrant is a court order because it is signed by a judge. Orly’s subpoena was signed by a court clerk only. It won’t work.

Unfortunately that’s not the way the laws of the state of Hawaii look at it. Any of us has the absolute right to publish our own information anywhere that we want. That does not give anyone else the right to have access to our information.
If you want to read the Hawaii law for yourself, just google Hawaii Revised Statutes 338-18. Its quite clear and easy to understand. Point 9 under section B covers Orly’s situation and why her subpoena was rejected. Orly needs a court order and a subpoena that is not signed by a judge is not a court order. If Orly wins on September 14th, she’ll have a court order.

I hear you loud and clear and agree wholeheartedly. I was honestly feeling that other Americans felt the same, however, when so many submit to the TSA molestations I have to wonder what happened to us? Don’t people see that this is only the Fed’s way of getting everyday Americans to accept being manhandled? I honestly expected that there would be such a push back on this that it would be immediately dropped, but that’s not what has happened. Looks like Americans will submit to anything under the guise of ‘safety.’ I will NEVER willingly agree to be radiated or molested for any so-called ‘safety’ reason. I don’t break the laws and these tactics are going way beyond what should be required for anyone’s safety (say what you will about Bush, but he kept us safe without using this kind of crap at airports). It’s especially maddening when many air travellers have seen Muslims get just their heads patted, if even that. I’m of the same opinion that not every Muslim is a terrorist, but most terrorsists are Muslims. Since when did the everyday American citizen become a terrorist? Since when have little kids in our country done anything to earn this title, yet here they are being forced to submit to TSA agents physically molesting them while their parents/guardians just stand by and allow it? Will this have a worse consequence later when some pervert/pedophile really does want to badly hurt them? Will they just submit? The whole thing is sickening, and yet thousands, maybe millions of Americans submit to TSA everyday. So, how many of our citizens will give up their weapons under whatever reasoning that’s given to them for doing so? I fear too many will since so many failed the TSA test that’s nothing more than getting the American citizen used to being manhandled by those in so-called authority. My husband and I feel like you do, Oldsalt. When all this started, we vowed we will never fly again. We will drive or we won’t go. However, we are retired, so that’s an easy decision for us. But the same goes in regards to being disarmed. We WILL die on our feet rather than give up our 2nd amendment. I pray that there are a Lot more out there of like-minds. Thanks for responding Oldsalt and thanks also for your service. My dad was in the Navy for nearly 30 years. Only at this time of Constitutional crisis, am I glad that he isn’t alive to see what’s happening to the country he served & loved so very much.

Here is some food for thought. While the snot nosed little drug heads are being trained to disarm American citizens, what do you think us veterans will be doing? We will be showing Patriots how to deal with people who TRY to DISARM US. We might be physically older ,and seen as largely infirmed,but our minds have survived and improved over time. We have not FORGOTTEN HOW. That is what we will be showing other patriots how to execute.

Your ‘facts’ are wrong. I have explained this several times; but you choose to ‘believe’ the people who steal and then misrepresent my work because they don’t read and study what they steal and so, have no idea what it means. Except in select states like SC and TX, in which the state party is still responsible, by state law, for Certifying the candidate on the ballot is qualified for the job; in 2006, the DNC took over the job of fulfilling individual state mandates viz a viz the ballot. This means, in those states – other than SC and TX – which require the candidate to be qualified for the job, to get on the ballot; the DNC and not the state party sent in those Certifications. What these thieves keep leaving out, because it would ruin their ‘conspiratorial’ meme, is that, the state party operates according to state party rules, national party rules, and state law. Foggy a.k.a. Bill Williams as a guest and around 14:26 into the interview P.J.
