“Lawyers for Rod Blagojevich asked a federal judge Monday to let them play more than 100 undercover recordings at the former governor’s retrial, maintaining they disprove the heart of the government’s charges that he was trying to sell a U.S. Senate seat.
Within a few hours, the prosecution fired back, calling the request a “redux” of arguments from the first trial and questioning Blagojevich’s intentions.
“It is unclear what purpose the defendant’s motion serves other than to potentially influence prospective jurors,” the government wrote.
Blagojevich’s legal team also accused the government in its filing of trying to sway public opinion, calling prosecution assertions at the time of his arrest that Blagojevich was selling the Senate seat vacated by President Barack Obama a “sensationalized false narrative” that “tainted the jury pool.”
Jurors deadlocked on 23 of the 24 counts against Blagojevich in his first corruption trial last summer, finding him guilty on one count of lying to federal investigators. He faces a retrial on April 20 on the 23 counts on which the jury deadlocked.
The defense team contends the 115 undercover recordings would show jurors that Blagojevich was not trying to sell the Senate seat but rather was negotiating a political deal to name Attorney General Lisa Madigan to the spot.”
“In a separate filing Monday, Blagojevich also asked Zagel to order that Antoin Rezko and Stuart Levine, both convicted of wrongdoing in the Blagojevich probe, be made available for questioning by the former governor’s attorneys because both might be “crucial witnesses for the prosecution” at the retrial. Neither, however, testified at the first trial, and the government hasn’t revealed if they will be called at the retrial.”

Thanks for asking, but I’m not sure yet. Flake has been a good man, I believe, but Sheriff Joe Arpaio is a star here in AZ when it comes to law enforcement. Perhaps it would be better for Arpaio to start as a Representative first rather than to try for Senator Kyl’s seat. His name recognition is greater than Flake’s, and that may be why he won in the recent poll. When the dust settles, things may be different.

Despite my linking Rep. Flake with Rep. Gutierrez above, Flake diverges quite a bit from the Chicago political flamethrower. I believe a lot of Flake’s good actions are the result of the pull of his Party in the House. But these may be openings for Arizona voters to guide him into a much better overall policy.
* Rep. Flake supported elimination of the visa lottery in 2004-05 (but has done nothing about it since then).
* On the all-important issue of removing the jobs magnet from illegal immigration, Rep. Flake usually votes on the right side, earning a “B+” Grade from NumbersUSA on that.
* True to his fiscal conservatism, Rep. Flake also nearly always votes against benefits for illegal aliens, including providing access to drivers licenses and other forms of ID.
THE OPEN-BORDERS FLAKE
Here is the record that should concern Arizonans who feel their federal government has allowed their state to be flooded by foreign workers (including illegal ones):
* Rep. Flake has the 8th WORST career overall immigration-reduction grade among House Republicans, according to the NumbersUSA grading system.
* He earns an F-minus grade for his support of increasing Chain Migration. He has never done anything to reduce it.

* And he earns an F-minus grade in the amnesty category.
Rep. Flake is running to replace the retiring Sen. Kyl whose overall immigration record with NumbersUSA is a “B” over his career. It would be much higher except for one episode in which Pres. Bush talked him into putting together the compromise amnesty in 2007 that the American people beat. Since then, though, Sen. Kyl has refrained from doing anything harmful on immigration.
Arizona voters should take every opportunity beginning today to obtain answers from Rep. Flake about what he would do about amnesties (he’ll call them legalizations), chain migration, the lottery and unnecessary foreign workers.
One sign that Mr. Flake is a little worried about his immigration profile in Arizona is the fact that he voted AGAINST the DREAM Act amnesty when it passed the House in December (but failed in the Senate). Which Flake will be running for the Senate?

The opening of 2011 state legislative sessions has been accompanied by a spate of birther-related bills, the clearest indication yet that the controversy surrounding President Barack Obama’s place of birth will continue to simmer throughout his re-election campaign.

At the state level, however, the issue continues to fester. This year’s bills, if passed, would create a requirement for presidential campaigns to prove candidates’ place of birth, a proviso that sponsors say would finally clear up the matter.
Election law attorneys say that if the bills are passed, states may be able to kick presidential candidates off the ballot for not complying — though a legal challenge would be very likely.
“The Constitution gives state legislatures plenary power to set the rules for choosing presidential electors. A state legislature, in theory, as Bush v. I personally like him. But not as President. Hia foreign policy sounds great if you are a philosopher or a political wonk. In practice I don’t see it being practical. As much as I would love to tell the rest of the world to effect off. So don’t think that I don’t like him or Rand. In fact I see Rand as being more Presidential.
I really don’t have a favorite right now. I’ve been watching that Herman Cain a bit. He looks like the real deal and I bet that he turns into the VP candidate at some point. I like Michelle Bachman A LOT. She is no dummy like the sexist Democrats are trying to make her out to be. I’m not sure that she is electable. Christie from NJ is a good family man and one of us, but he says that he won’t run. I used to be a Romney guy, but not any more (although he’s better than and Democrat). Gingrich gets on my nerves and is too wishy washy. Palin is unelectable and I don’t think that she is ready for the complex problems that our nation faces. Paul Ryan has the brains, but he may be a bit too dull for the general populace. I used to like Pawlenty, and still do more than most, but his latest birther comments really bothered me. Cabby, I’m definitely not PRO War…I hope that most people aren’t, but his stance with regards to our role in the world is far too laissez faire…I’m not saying that we should intrude into the matters of every sovereign country in the world, but we need to look out for our best interests. We need to start to keep more of our money here and stop being the nanny to the rest of the world (so I agree with him there).
With respect to the “Ground Zero Mosque”, you know my stance on Muslims in general, but I see this being a local zoning issue. But if approved locally, the funds must be highly scrutinized via the Patriot Act provisions in the banking laws. I would personally not like to see the Mosque being built in that location, but as an advocate of freedom of religion and keeping government out of most matters it is a difficult position. I think that the money coming in to build the mosque would have monies attached to terrorist organizations and that is where the battle should be fought.
As a person who is not in the military, or ever served, I’ll reserve my opinions on gays serving openly to the military. I have many friends who have served our country in battle and will defer to them on that issue.
With respect to his approach to fiscal matters, my opinions are nearly identical to his. He is a libertarian, believes in local governance and a minimum of federal intrusion.
I love him as a person and I respect his convictions. He kind of reminds me of Dennis Kucinich, whom I disagree with on everything, but it’s hard not to respect the man for his convictions.
I don’t believe that our movement is asking for people to walk “lock step” in their political beliefs. We just want to get rid of the two faced bastards, in my opinion.

JS. I am not putting out any “false information”. I never said that I was a proponent of the Fed. I said that it is our current monetary system and therefore it’s rapid demise would destroy the life savings of a couple of hundred million people. Calling for it’s collapse without an adequate replacement is folly.
Secondly, you are wrong. The IRS is the law and the Supreme Court has said so. I think in the late 1890’s it was ruled unconstitutional and that is what you may be referring to. I do agree that the progressive income tax system could be unconstitutional given the fact that some pay more than others, but good luck getting the system changed. (FS could probably elaborate a bit more on this subject). You can choose to be a tax protestor, but I prefer to stay out of jail. Also, although I believe that we are overtaxed, I am not opposed to safety nets, national defense and the like. Therefore, it’s abolishment is not something that I am a proponent of. I would like to see government streamlined with less waste, no public unions and limiting bureacracy. I would like to see the department of Education take a back seat and give the money to the states via block grants. Public education is very important and many of the poorer states do not have the capacity to run an adequate school system. But that doesn’t mean that the decisions shouldn’t be made locally. In additon, the elderly need to be looked after. This is why I am a proponent of the social security system, although I would look at possibly semi-privatizing it so that your account is attached to you as an individual. Then there is the Interstate Highway system and many other infrastructure projects that the states need assistance managing with funds.
The issues involved in totally collapsing our federal government is ridiculous. I am definitely a small government libertarian, but even Ron Paul doesn’t advocate some of the things that you regularly call for on this blog.
Lastly, I have said many times that (although I admire the man) I am not on the Ron Paul bandwagon. So I’m not sure where you are going with that. He should not be President in my opinion, although if he won the nomination I would vote for him in the general election.
JS. I guess what I am trying to say is that things are pretty jacked up with our federal government and many of the institutions. But a rational approach needs to be taken. No offense, because I think that your heart may be in the right place, but to me you are no different than the radical socialists that want to collapse the system to implement their agenda. By all means, audit the Fed. Replace it even, but for God’s sake be smart about it. You spend an awful lot of time researching what is wrong with our institutions. But they are there for a reason. This does not mean that there may be better alternatives or that they are currently (or always have been) corrupt. Mankind is always succeptable to corruption, especially where materialism is concerned.

Paxson, I remember reading about this several weeks ago in an article but didn’t have the time to search out the link. All I know is that this was a separate issue from the FCC ruling in December, because Obama is calling for the Commerce Dept. to institute this bold move. I don’t know what reason he is giving, but it is obvious that it is another attempt to control the internet and to chill free speech. These orders are called “secretarial orders”, not “executive orders.” I assume it is a move similar to those taken by EPA that Congress has little say over. We are on very dangerous ground, imho.
