Judge Susan Bolton may enjoin Arizona Law in part, SB 1070, Section by section

“In a day filled with protests, arrests, legal arguments, an appearance by the governor, and at least one certified neo-Nazi, the most significant developments in the SB 1070 saga happened within the Sandra Day O’Connor U.S. Courthouse in Phoenix, not without.
There, Judge Susan R. Bolton oversaw two hearings Thursday where the plaintiffs sought to have her enjoin SB 1070, Arizona’s new “papers, please” legislation. But Bolton, without indicating when she would make a decision, signaled that if she enjoins SB 1070, she will do so in part, perhaps gutting significant portions of the law while leaving the remainder ready to go into effect July 29.
Whatever her decision, legal experts anticipate that her ruling will be appealed to the 9th Circuit Court of Appeals, which would likely put the law on hold.
Although lawyers for the ACLU, MALDEF, and finally the U.S. Department of Justice argued in separate hearings that the law must be taken as a whole, Bolton kept directing them to the specifics of certain provisions.
“You’re not asking me to do that?” Bolton asked ACLU attorney Omar Jadwat at one point in the morning hearing on the ACLU/MALDEF suit about his request that she enjoin 1070 in its entirety.
“Shouldn’t we be talking about it section by section?” she continued. “And talk about what you want me to enjoin?”
She cited the severability clause in the statute, which would allow her to partially enjoin, while leaving the rest of the statute in force.
Jadwat contended that the law’s stated intent, to make “attrition through enforcement” the policy of Arizona, indicated that all parts of SB 1070 were meant to work together toward this goal.
However, Bolton declared that, “I cannot enjoin the [law’s] intent.””
“”Why can’t Arizona be as inhospitable as they wish to [illegal immigrants]?” wondered Bolton at one point.”
“Playing devil’s advocate, Bolton observed that not a day goes by without the news reporting on a drop house being busted by authorities. Didn’t Arizona have a legitimate concern with “public safety” and the “dangerous situation” that harboring illegal aliens causes?”
“Bolton does not have to issue a decision on an injunction before July 29, the date 1070 is scheduled to go into effect, but most observers believed she will.
It’s worth remembering that an injunction would not overturn the law, just place all or part of it on hold until the various lawsuits play themselves out. The question remaining seems to be how much of the law Bolton will allow to go into effect come the 29th.”

I did find a very interesting bit of news in this article though that confirms my original suspicions. This has details (but doesn’t draw deliberate attention to them) that the men were not just seeking a license for driving the company van around. Follow:
When Sakher A. Hammad was arrested, he had in his possession a visitor’s identification card that gave him access to the building just a few days before the terrorist attacks.
Hammad, a plumber, told federal authorities he was working on the sprinklers, according to court testimony.
DiScenza dropped government objections to a release on bond after Hammad’s father, Peter Hansen, put up his Staten Island home as security for a $250,000 bond.
Hansen, a senior engineer for the City of New York, testified at the March hearing that his son was “born again” when he came legally to the U.S. from Jordan.
“America is our country,” Hansen said as his son wept. “We are a very dedicated family. We love work . . . We would never think to do harm to anyone.”
But DiScenza urged the judge not to grant bond to the others.
When Donald upheld detention without bond for the other four, she called them flight risks because of their immigration status or substantial connections through family to other countries, where they might flee if released.
She noted that Odtllah, the alleged leader of the fraud scheme, has a wife and family in Jerusalem.
But the judge said in her ruling there was no evidence to support “these potentially inflammatory assertions” about connections to Sept. 11.
Here’s how prosecutors allege the scheme worked:
Odtllah, who has been living in Cordova for two years, offered Tennessee driver’s licenses to illegal immigrants for a fee of around $1,000 each. The Hammads, both self-employed plumbers in Brooklyn, acted as middlemen, finding the clients and bringing them to Memphis, where Smith would issue them licenses.
In early February, the Hammads allegedly drove co-defendants Fares and Abou-Shahin and a juvenile to Memphis from New York City to get four driver’s licenses – one in Fares’s name and three in names that prosecutors have said appear to be aliases.

Fine also filed an emergency writ of mandate in the Ninth Circuit Court of appeal to order the District Court to issue the writ.”

For those who wonder about jbjd? So do I.
I have been reading her posts for nearly 18 months. She uses lots of words that are legal sounding. She says lots of things that seem to be meaningless. She reminds me of Obama the first time I ever heard him speak. Obama used many, many words in a short space of time and I had no idea what he said.
A couple of months ago I had a conflict with jbjd over Obama’s eligibility. In essence she defended Obama stating he is eligible because he won the election. .. I ended the piece by asking jbjd whose side was she on because she sure seemed like an obot to me?

I agree with this statement. However, some of the people whom you have called out have had 2 years of marinating their thoughts on this blog. I ALWAYS try to “read between the lines”. Being a Democrat, she perhaps views these matters differently than some of us who are in varying degrees of conservatism. She tries to maintain professional integrity and has added much to the dialogue. We all have different personalities and must take that into account when we judge statements and motives.
When it comes to the issue re.Maldonado, I do believe that her article has proved to be premature, but this type of thing can happen to anyone who is in the practice of staying on top of breaking stories from a legal perspective.

Based on the record, I made conclusions. Nothing in the record has provided a basis to alter these conclusions. Namely, I thought Mr. Maldonado was deceiving the public for political gain. But this is all spelled out, with direct references to the record, on my blog.
As Maria pointed out here the other day, I do not respond to personal attacks. But I find watching people continuously snookered by wannabe politicians and their less than scrupulous backers, to be really sad. Ask yourselves, why didn’t Mr. Maldonado produce a letter – and it’s not the letter he claimed he received, the 2nd letter, Certified or Registered, he claimed both at different times – until he had been telling his tale for almost 2 (two) months, and only when an anonymous blogger suggested he was not being straight with the public? For the same reason he began discussing a downloaded copy of a 2-year-old electronic image from a layout on the paid political advertising platform named, “Fight the Smears.” (Remember, this electronic image was only visible with the aid of a computer screen; the mockup of the ad was never released to the public.) As a reader of my blog said, “Then, it hit me, he is only doing this to up his position in the election race of publicity. He is one of nine ‘R’ candidates for Senate in MO. What better way to razzel-dazzel the folks in MO and elsewhere by attacking BO and his B/C and feel victimized by anyone who disagrees with him…”
Also, please, be aware a difference exists between labeling me a D because you think that’s where my political bent lies; and indicating I identified as a D. Because I did no such thing.

Just a quick update on the Quo Warranto aspect of our representing the Chrysler dealers. Both Steve Pidgeon and I agree that our clients should exhaust all possible remedies pertaining to the Chrysler bankruptcy before seeking Ex Relator status in the DC District Court. Filing a petition now in the DC District Court would be premature as we’ve recently filed a Notice of Appeal with the Southern District of New York. But we do represent 82 former Chrysler dealers – led by James Anderer – who support a future quo warranto action.

Hector Maldonado may well be, on the whole, a decent guy, but he (in my opinion) attached himself to the eligibility movement for his own purposes.
What did anyone of him before he did this?
Had he ever brought up the issue of eligibility before?
He claims he was discriminated against, but the fact is, as someone who had only voted once (and that recently) in the last 8 years, he was in a different position to most ‘living at home’ candidates who had voted regularly (as bona fide USA citizens).
One recent vote demonstrates nothing more than that he was a citizen and eligible to vote, a year or so back, but he’s aspiring to an office with qualifications as to *length* of citizenship, nothing to do with place of birth.
Evidence of Hector’s eligibility was lacking, so someone asked for further evidence that *proved* the length of time he was a citizen, and so, *eligible* for the position he seeks to fill.
Hector Maldonado, in my view, used the eligibility issue to get loads of airtime/name recognition among Tea Party members.
Smart move…as far as it went, but he’s not some sort of hard done-to Obama eligibility attacking hero.

It would seem that most Americans are not tuned into Australian politics. The point is that yes I agree that those Muslims who are attempting to introduce Sharia law should go back to Pakistan or the Middle East. These people are a true drain on our economy, especially when they go ahead and have up to 4 wives even though that is against our laws. Personally, I am in agreement with all attempts to ban the burqa. I will, however, accept the hijab but I do see the women having that look in their eyes that says “superiority”.

Now to clarify our political system. We have a Federal Parliament consisting of two houses: Representatives and Senate. The leader of the party that wins the elections beomes the Prime Minister. We also have a Leader of the Opposition. Since we are a Constitutional Monarchy, the Queen’s representative is the Governor-General.
Up until a few weeks ago, the Australian Prime Minister was Kevin Rudd, aka KRUDD (for those of us who disrespected him). He was unpopular for the same reasons that Obummer is unpopular. He is a lying weasel. KRUDD was stabbed in the back by his deputy leader, Julia-the-Red Gillard. I call her that because she is a Marxist and she pretends to be centrist…. sound familiar?
Well the familiar things go beyond that pretence because now the watermelon known as Julia-the-Red Gillard wants to introduce the failed cash for clunkers scheme…. more government waste.
My interest in American politics stems from the fact that a lot of what happens in the USA will also happen in Australia.

As many others, I have sworn off these topics recently. However, with the Ted Turner, Jim Jones or what ever his name may be, I found the legal curiosity of reprecusions upcoming with him and his cult followers.

If this Tim guy even attempts, and I mean attempts, to instruct our military in the slightest way, in his self proclaimed capacity, it will be quite awhile before he sees the day of light outside a prison.
If this Tim guy even attempts to install with demand funds to support his self proclaimed government, again, it will be quite awhile in prison.
In the meantime, he can claim what he does including king if he wishes. But once he asks for money to run his internal government, he is done for.
Having said that, how can anyone run an entire country, protect its borders, ensure domestic economics and tranquility, hire and pay for its military, its branches of self government, judges, reps, ect. Without a single penny?

My gratitude to all those who serve honourably in the military is boundless.
I truly honour his service and the sacrifices he(and his family) made during his years of service.
However, that is unrelated to the issue as to whether he was ‘discriminated against’ when he was asked to provide proof that he was eligible for the post he seeks.

The longer it takes the powers that be to remove Obama from office the more time the regime has to build strength. The harder it will be to remove him.
This issue of Obama’s eligibility has been stonewalled by main stream media, the corrupt judicial system, both Democrat and Republican elected officials since prior to the electoral college vote in spite of the many brave ( Phil Berg, All Keyes, WND, CW, Andy Martin, and more) people screaming and hollering about the Natural Born Citizen issue.
Since then overwhelming evidence has come forward that supports the fact that not only is Obama not a Natural Born Citizen and therefore does not qualify under Article II, section 1, Clause 4, HE IS NOT EVEN A “NATIVE BORN CITIZEN”! In fact he is a Kenyan born citizen and therefore not eligible to be our president. He is a USURPER AND A FRAUD. This fact has put America in the gravest constitutional crisis in her history. THIS IS A NATIONAL DISASTER! Therefore until Obama’s presidential legitimacy is settled once and for all, there should be no other priority in America today—especially for the hopeful candidates come November.
According to Dr. Edwin Vieira if Obama is a usurper (as we all now know he is) “. . . not only will the Constitution have been egregiously flouted, but also this whole country could be, likely will be, destroyed as a consequence. And if this country is even credibly threatened with destruction, every American will be harmed—irretrievably, should the threat become actuality—including those who voted or intend to vote for Obama, who are also part of We the People. Therefore, in this situation, any and every American must have “standing” to demand—and must demand, both in judicial fora and in the fora of public opinion—that Obama immediately and conclusively prove himself eligible for “the Office of President.”
The candidates are asking for our vote November 2010 are trying to convince us they will work on taking back America and restoring it to it rightful Constitutional Republic. They are promising to work on the economy, jobs, housing, lending, repeal the health care plan, taxes and immigration while totally ignoring the very cause of America’s problems today. The cause of these problems is a usurper president who has violated our constitution and forced unwanted policies and laws upon America that is destroying America before our eyes… (Won’t list them here.)
These candidates haven’t got their priorities straight. Not one—not one of their road to hell pie in the sky promises and good intentions will ever become a reality until the imposter in the white house is arrested, tried, found guilty and permanently jailed will become a realaity. America cannot recover as long as this criminal continues to imposter as president. These snot nosed punk candidates who are praising this king’s new suit of clothes while asking for your vote need to be challenged.
What is worse are the people who are failing to bring the eligibility issue forward by demanding their candidates make this the center of their platform. Every patriotic American should be insisting that those in office and those running should demand Obama prove his eligibility or step down! Any American who is not demanding Obama stand up or step down is a traitor to his country!
The consequences of an imposter president are great! Politicians and candidates who fail or refuse to confront this issue directly are betraying their would be voters, constituents and America. They are also violating their oath of office.

1. The candidates are complicit in Obama’s usurpation of the government
2. Candidates are in denial
3. Candidates are obfuscating
4. Candidates are placing their careers above country
5. Candidates are deceiving their supporters and voters
6. Candidates are neither different nor better than the corrupt incumbents who violated their oath and duty to protect and serve the Constitution of America and serve their constituents by protecting their best interest.
7. Candidates have already betrayed their country to satisfy their own ambition
8. Candidates will most certainly betray their public trust when confronted with a vote against the public in trade to stay in power

As many others, I have sworn off these topics recently. However, with the Ted Turner, Jim Jones or what ever his name may be, I found the legal curiosity of reprecusions upcoming with him and his cult followers.
Yea, there can be legal reprecussions. ..
If this Tim guy even attempts, and I mean attempts, to instruct our military in the slightest way, in his self proclaimed capacity, it will be quite awhile before he sees the day of light outside a prison.
If this Tim guy even attempts to install with demand funds to support his self proclaimed government, again, it will be quite awhile in prison.
In the meantime, he can claim what he does including king if he wishes. But once he asks for money to run his internal government, he is done for.
Having said that, how can anyone run an entire country, protect its borders, ensure domestic economics and tranquility, hire and pay for its military, its branches of self government, judges, reps, ect. Without a single penny?
That is the question. If he askes for it, he is done and in prison. Don’t believe me? Let Tim appoint you as the Govenor of Tennessee, then you step in and attempt to take over, including but not limited to the National Guard.

I reported here earlier that I had posted an article about a group called National Popular Vote Initiative, headed by a man I described in the article as a Democratic fairy godfather – he won his money inventing the lottery scratch tickets – who was stealthily hopping from state house to state house enlisting legislative support that would reorient the vote for President away from Electors of each state. In that article, I describe how ‘stealing’ an election would be made easier if this scheme passes. I provided the link. But instead of discussing how our electoral system is being undermined right under our noses; many posters here have spent hours discussing how “jbjd” was unfair rejecting the candidacy of Hector Maldonado for U.S. Senate in MO. Worse, you put words in my mouth when reading the explanation offered on my web site would have eliminated your arguments. For surely you are not faulting me for rejecting the candidacy of a man who 1) registered for the ballot via mail, thus obviating the need to produce identification required by law for in-person registrants that they are eligible for the job; 2) refused to produce identification 3 months later when requested to do so by election officials as a condition of remaining on the ballot, even laughing when he publicly admitted he ignored this request; and 3) charged his opponent, the SoS, with discrimination (but only in front of his new found supporters) for demanding evidence of eligibility, contrasting this situation to that of the D candidate for the Presidential primary, notwithstanding he admitted, MO election law treats these 2 (two) situations differently with respect to who is supposed to verify ballot eligibility. Clearly, the problem I exposed is that, many of you cannot reject BO solely because he failed to establish eligibility; since you embraced Mr. Maldonado for several months BEFORE he agreed to produce any documentation, he could be eligible for the job. So, why did you reject BO’s candidacy? And now, you embrace Mr. Maldonado’s candidacy notwithstanding all of those months he thought it was a joke not to let anyone know for sure whether he was Constitutionally eligible for the job (even while he proclaimed his respect for law and order); and then he publicly condemned me for expecting more!
I have said this before; stealing an election from the likes of us must have seemed to BO and his crew, like shooting ducks in a barrel. And 2 (two) years from now, I would expect stealing the election will be just as easy.
Ha, I have no doubt you will blame me again at that time for not working hard enough, for free, to stop him on your behalf.

Oldsalt and my fellow patriots,
I am at a loss for words tonight. Somehow I feel that the ‘infighting’ between those whom are concerned about the direction of this country is now counter-productive. To be certain, the media denouncement has brought fear into the likes of everyone, even proud upstanding congress people like Ron Paul. The truth is important, and is not a preception but a truth, and the search for that truth is just. Many of us search for truth in quite different aspects, but the search for the truth of what has happened to our government is patriotic, no matter where it leads.
You can call me closed minded, but the truth that I have found sickens me. The government is no longer for the people, by the people, but for itself. The media of this country, the watchdogs of democracy, have chosen a different path. The have chosen a path that overcomes the public discussion to change policy and Constitution, to one of subversion. They have decided that the evils of Democratic Socialist agenda are more important that that of the Constitution. They have committed treason, a process so deep and destructive even the good and honest fear to question the criminal acts around us.
Our weapons are not guns and knives, yet. Our weapons should be the truth and information. Does the public know it has been lied to? Does the public know that the current government is so corrupt that it makes US Grant look like a choir boy? Does the public feel anger at it’s governement for failing to listen? Does the public know that the left Cabal manipulates the news?
We should enjoy to find like minded individuals and pass on information about the Treason that has enveloped this great country. We should make certain that American Patriots Vote. Clearly, any chance that is given us to make certain the next election is legal, should be taken.
I know, I know, for months I have predicted this will all end in violence. I so want to be wrong. November is our chance, talk, discuss, tell people, give the process your best effort. Don’t loose spirit, don’t become numb, get ready to vote and really make a change.

Anyone who has honestly checked out the raw footage that came from the police vehicle, at the scene of the deaths of the two police officers, can clear see that the Kanes were pulled over by the police and that after Jerry Kane had pushed one officer into the ditch that Joseph Kane got out of the vehicle with the AK-47 and that he opened fire, killing the police officer, plus they can see Jerry Kane getting back in the vehicle and then Joseph Kane firing on the other officer with the AK-47 as it is exposed on his side of the car, and killing that police officer.
The other raw footage shows the Kane car being rammed, followed by the shoot-out in the Walmart carpark. Two more police officers were injured via the bullets fired by the AK-47 that belonged to the Kanes.
I would have thought that rather than being on a DHS list that the Kanes would have been on another list relating to fraud.

I’ve been offline for a couple of days and when I got back on I had to plow through about 500 comments of drivel.
Some of you post the same comments over and over. Some of you post long bits of narrative where links would be easier for everybody.
But, mostly, more of you need to do what I did. Just swear off certain topics, and perhaps certain individuals. Don’t engage them in dialog – let them just talk to themselves and spit into the wind.
Overall, we all need to help each other by staying better focused. Something new to say is very helpful – repetitive posts and off topic, not so much. Above all, the personal attacks just have to stop. And, unfortunately, that means we all need to take the high moral ground and not even attack the people who are attacking people. “Don’t feed the trolls”.
Nothing like being away for a day or two for a little perspective!

The words “obot” and “liar” and “lies” are used entirely too freely and without discrimination. Snap conclusions, rash judgments, and sharp remarks seem to be in abundance these days. I am holding one of my recent rescued animals in my arms as I am typing this. I have 10 I have taken in this week to get neutered & spayed and shots. I will use the “Neuter Commuter” in my town to get them done for only $25 each and find good and safe & loving homes for them.

I also took off yesterday. It was the 4th and final day for the hunters safety course I was involved in with my youngest two children and one of their classmates. They all 3 passed the final written and field examine, proud of them all.
It was however a gruesome 7 hours in the heat as temps. With heat index reached 111 deg. F. Returned back home around 4pm and was exhausted.
I did a veterinary assistant clinical rotation in school with nine veterinarians and in the “Neuter Commuter,” and I learned a lot here…. I am.still going to college and working too….

Although I am not an attorney, I have read the Arz bill and it appears to be completely in-line with the federal immigrations law. I have also reviewed legal experts analysis such as the Heritage foundation and they also state the Arz law is legal.
Personally, I don’t think the judge can remove any portion of it. But that is my opinion. It will be intersting indeed to see what she does. I am kepping an eye out on this issue. I hope she seens the feds and liberal groups back to DC with their heads stuck up their …………
