“Kerchner Appeal Filed with Third Circuit Court of Appeals in Philadelphia PA
This is to give notice that today, Tuesday, October 27, 2009, at 2:19 p.m., I filed an appeal to the Third Circuit Court of Appeals in Philadelphia PA of Judge Jerome B. Simandle’s dismissal of the Kerchner et al. v. Obama & Congress et al. case.
Recently, the Hon. Jerome B. Simandle decided the Kerchner case, granting the defendants’ motion to dismiss the case. As I explained, through the dismissal, Judge Simandle avoided having to reach the merits of the question of whether Obama is an Article II “natural born Citizen” and eligible for the Office of President and Commander in Chief.
In the Kerchner complaint/petition, we allege that Obama has not conclusively proven that he was born in Hawaii. More importantly, we also allege that he is not an Article II “natural born Citizen” because when Obama was born his father was a British subject/citizen and Obama himself was the same, citing E. Vattel’s, The Law of Nations (1758) and John Jay’s letter of 1787 to then-General George Washington regarding providing a strong check on keeping foreign influence out of the Office of Commander in Chief by requiring that only a “natural born Citizen” occupy that critical and powerful office. As a naturalized citizen cannot be President because of being born subject to a foreign power, neither can Obama. It is important to understand that the Court did not rule in the Kerchner case that Obama has conclusively proven that he was born in Hawaii. It is also important to understand that the Court did not rule that Obama is an Article II “natural born Citizen.” Rather, the Court dismissed the plaintiffs’ case because of jurisdiction (Article III standing and prudential standing) and the political question doctrine without commenting on the underlying merits of whether Obama is constitutionally qualified to be President and Commander in Chief of the Military. The Court also did not rule that the plaintiffs’ claims are frivolous. By the Court finding that plaintiffs do not have standing and that their claims present a political question, the Court was able to avoid having to address the underlying merits of the Kerchner case. With such a decision, the American People unfortunately still do not know where Obama was born and whether he is an Article II “natural born Citizen” and therefore constitutionally eligible to be President and Commander in Chief.
A court cannot refuse to hear a case on the merits merely because it prefers not to due to grave social or political ramifications. As I have shown in my essay entitled, http://puzo1.blogspot.com/2009/10/real-kerchner-v-obama-congress-case-is.html, the Court’s opinion dismissing the Kerchner complaint/petition did not address the real Kerchner case but rather looked for a way to dismiss the case without having to reach the merits of the question of whether Obama is an Article II “natural born Citizen.” It is my hope that the public will take the time to read the Kerchner complaint/petition and the legal briefs that were filed supporting and opposing the defendants’ motion to dismiss so that it can learn first hand what the Obama ineligibility case is really about and draw an intelligent and informed decision on whether Obama is constitutionally qualified to be President and Commander in Chief of the Military.
The case is now with the Third Circuit Court of Appeal in Philadelphia PA which court we hope will decide the real Kerchner case and thereby reverse the decision of the Federal District Court. The American people deserve to know whether Obama was in fact born in Hawaii. More importantly, even if he is born in Hawaii, given that he was born with dual allegiance and citizenship, the American people deserve to know whether he is an Article II “natural born Citizen” which would make him eligible to be President and Commander in Chief of the Military. It is our position that because Obama was born with conflicting allegiances and citizenships at birth (British and U.S., if he was born in Hawaii), he cannot be President and more so Commander in Chief of our military men and women.

The school was aware of it and apparently did not do anything (counselors/teachers are supposed to report child abuse). This is a terrible situation. When I first realized about 22 months ago that the likes of Obama could not possibly be a credible primary candidate, let alone the president, I began to do some serious research. My background is not in political science so I was venturing on new territory.
Two things I learned. First that entities like Bilderberg, CFR and Trilateral Commisssion actually existed and secondly that there was an expansive international drug trade, that essentially commanded the flow of finances worldwide. At one level I was not too surprised, but sobered by these revelations.
In light of that it’s not surprising that a significant portion of the International Monetary Fund launders 5 to 6 billion a year (as the speaker said, that’s probably conservative), and the governments worldwide are complicit in these exchanges. But here we are. Thank you for the link. I do my best to keep up with the flow of great info that bloggers on this site offer.

Honey is a natural food, and you can eat it until the cows come home…use it straight, in tea, coffee, on toast, however you want. You can’t go wrong with honey!
Sure, you can use it with the apple cider vinegar in fact, I was feeling a bit achy and congested last night, but rather than mix honey and ACV in hot water like I usually do, I took 2 teaspoons of the vinegar, and mixed it with a couple tablespoons of the honey and stirred. It was good and just tasted like honey with a bit of a bite. Feeling A-OK today.
As I mentioned to Carmen, if you’re fighting allergies/sinus issues, buy honey locally…the stuff that’s made within 50 miles of you is the best because it contains ‘local’ pollen and that’ll build up an immunity to the pollen in your area for you.
Glad your sis feels better…I think we all need to keep these natural products on hand for the coming winter season.

Thanks Bob. So it came down to an “O’Bloviate” segment only. Figures. He loves macho soundbites – but he’s definitely been looking old lately plus losing the hair more and more. They should give Beck his slot and put Lou Dobbs in Beck’s. None of them want to commit to the eligibility question though because they just don’t know Constitutional law or care and want to wait ’til the patriots get all bloodied up – then report it later and take the credit.

The statute specifically states that the date of filing is the date that a document is “RECEIVED” at the DoH office. O’s data was received or “FILED” on Aug. 8, 1961. It was never “ACCEPTED” by the Registrar….Obama’s COLB is still being “MAINTAINED” awaiting acceptance by the Hawaii State Registrar.

I’m not a doc, but here’s what I’d do:
For the Sambucol, that ‘intensive’ dosage on the label is right…I’d keep it up until his symptoms subside.
As I told Denise, I used a few teaspoons of the vinegar with a good slug of honey last night and it was pretty good. Maybe that’d be better for a young child, rather than to try getting a hot liquid into him.
The important thing, Rocknee, is to keep getting fluids into him. Water is best, but kids like sweet stuff, so you may want to get some Gatorade in a flavor he likes. You need to replenish his electrolytes, and the Gatorade does a good job. He also needs to sleep as much as he wants.
While waiting for test results, I’d go on whatever advice the doc gave you. I’m glad that he was tested, because not too many are bothering to test these days.
Please post how he’s doing, and keep your daughter on the natural remedies, too! It’ll run its course, but your kids can feel better while it’s doing that.

She’s a little better this week. Last week ran a temp and then it dropped and she was cool to the touch, among other things which I won’t post here, very lethargic and slept a couple of days for the most part. Saturday, I brought her Communion after Mass and she is much better. She’s still weak, though. But, at least she is more responsive, has an appetite and is alert when awake. Sleeps a lot in any case. I saw the piece on O’Reilly tonight regarding Orly. Basically, if you knew absolutely nothing on the matter before watching, then you know absolutely nothing after watching. No information or insight was provided.
It was basically the same as every other segment of the show….O’Reilly interviews various employees of Fox, and arrives at no conclusion, breaks no news, and essentially wastes the time of everyone watching.
Here’s what I sent O’Reilly:

Please, have a literate person do a little research for you! Here is the Hawaii statutes on the “FILED” and “ACCEPTED” on the COLB: Both 11-1-4(d) and 11-1-28>http://hawaii.gov/health/about/rules/prac_proc.pdf
The statute specifically states that the date of filing is the date that a document is “RECEIVED” at the DoH office. O’s data was received or “FILED” on Aug. 8, 1961. It was never “ACCEPTED” by the Registrar….Obama’s COLB is still being “MAINTAINED” awaiting acceptance by the Hawaii State Registrar.

I have three family members’ COLBs from Hawaii and they all have the same notation “Date Filed by Registrar”. I have sent a scan to Orly and CW. As far as I know there is nothing unusual about the three births that would require “filed” instead of “accepted”. This different wording may be insignificant. I read that the Hawaii DOH changes their forms every few years or so. Maybe that is the reason for the difference.

LM-Thank you for the Valerie Jarrett video-she cracks me up. Truth to power, everything is distortion of the truth to them, a concept they are not familiar with. What about the GIANT transparency problems? Like Obama’s documents that are sealed. I have yet to hear them speak to specifics. The American people are smarter than that, yes and they have told you every way but up that they hate this bill. On the poll it said 70 per cent would not vote for THE ONE in 12. Hope he is arrested before the end of the year so that he is not in office one year.

First, we cannot assume this Renee is Barack Obama’s child. There are other Obamas listed under Ancestry.com’s U.S. Public Records Index and Phone Directories that lived in Maryland who could be parents of a child born in 2004. We wouldn’t want to smear the name of an innocent child or add to the grief of her parents by falsely proclaiming this is Obama’s love child.
Birth announcements and obituaries can be found on microfilm in the newspaper archives at some libraries and genealogical societies. Save time and call first to see where the archives are located. For a fee, some libraries will search for you and mail or email copies of an obituary. Someone who is in Maryland may want to look at the 2003 – 2005 city directories for Obamas to see if possible parents may be listed. Problem is, does anyone know for sure in what city Baby O died?

Excellent article, as it describes narcissistic rage, a pathological state that cannot be contained.
Read this article carefully. It outlines what Fox has successfuly accomplished, and will continue to do.
I have mentioned, like others, that Obama is not just a narcissistic person, he has malignant narcisissm which is an entirely different category. Fits of rage are frequent when the reflected self is not what it must be. This is truly Obama’s Achilles heel. This form of rage, despite his cool outward appearance destabilizes character. If continued relentlessly (like Fox is doing) it leads to a disorganization of the rational person, and renders them unable to function.
I know everyone is upset about the BC, but it appears Fox is putting its eggs, where they deem it most effective, and where the Repubs’ hand in the support of Obama (the power elite) will not be exposed. Its working and that really is what matters. Obama is spending more time preoccupied with Fox and his inability to pass health care than to attend to instability in Afghanistan and Iran. This will not be tolerated for much longer.
The Dems who are sitting on the fence are the ones that need to be contacted by the public.

Stopped watching the no spine zone early this year after my letter to him produced..crickets.
Stopped watching Hannity& Colmes after months of Hannity raving about “unrepentent terrorist”
& “just a guy from the neighborhood” yada, yada, yada. Very stale and never probing as a journalist should do. there was just enough tension to keep you tuned in, but never anything of actual importance. So the result was as planned by the masters of the show. people knew that the truth would never be revealed, at least not on fox news. But, and this is a big but…you kept tuning in, to Hannity-O Reilly-Greta ETC. They got ratings, you got bullshit.
Now due to their complicity in the cover-up…you’ll never convince me that they don’t know what we know..they must continue the charade. This is the sad, sad, state of journalism in this Country. Lie for ratings. Lie for the sake of political correctness. Lie when it suits you.
I get 95% of the news from the internet. Various places as need be. I’d prefer to see a new growth industry in America that eliminates the dinosaur media once and for all.
There are plenty of talented operations around, like CW and others to get the truth from. Places that have as a starting point a love for the American way of life, American exceptionalism, and a deep love and respect for the Constitution of the United States. Let us all begin to support these Patriots and help grow these “new” industries. Maybe the rest of the corporate “media” will finally go the way of their ancestors; the dinosaurs.
