The same day that Philip J Berg filed a Motion for Leave to File Amended Complaint, Obama and the DNC filed a Motion to Delay Discovery until Judge Surrick rules on the prior motion to dismiss. Jeff Schreiber does a good job of explaining this. Here are some of his comments:
“It was a busy day in the Eastern District of Pennsylvania today. First, attorney Philip Berg files a motion asking the court to permit him to file an amended complaint with several additions, and then next, attorneys for Barack Obama and the DNC file a motion asking the court for a protective order, essentially asking that the judge rule on their motion to dismiss for lack of standing before ruling on Berg’s motion for expedited discovery. ”
“Basically, the law states that Judge Surrick can order discovery even in the face of a pending dispositive motion such as the motion to dismiss filed on September 24 by Obama and the DNC. In other words, he can order full discovery, limited discovery, or none at all before ruling on the dismissal. The attorneys for Obama and the DNC, however, just filed a motion asking for a protective order stopping “all discovery in this action pending the Court’s decision on defendant’s motion to dismiss the action for lack of subject matter jurisdiction and for failure to state a claim upon which relief can be granted.”
Just like with the amended complaint, an attorney cannot simply file a protective order but must file a motion for one, essentially asking the court to issue one. Make sense so far? That’s what this is — defense attorney John LaVelle filed such a motion this afternoon, a motion asking the judge to issue a protective order which would allow for a ruling to come down on the motion to dismiss before the commencement of any discovery.”
Mr. Berg’s comment:
“He’s asking to delay discovery and, Jeff, I’m obviously going to oppose it, ” he said. “This isn’t right. This just isn’t right. By tomorrow, we’ll have a response and put out a press release. The American people should hear about this and, if they do, they should go nuts. It’s time to put up or shut up.”

I really for the first time in my life may become ashamed of the unblievable positions the courts in America are taking. They can legally spy on you. We are losing our freedom. If Obama is elected I truly believe we are all in trouble. Where has our America gone? We must stop this man before it is too late.
This is beyond belief; if this were you or I we would already be deported failing to produce documentation of citizenship. I mean this has been progressing since August 28, 2008. I think they are stalling to try to get Obama elected then use executive privilege to avoid having to deal with it. There must be some way to expose this individual for what he is. I find it hard to believe that a simple requirement that any person born in the United States could comply to is such a complex law issue. I wish there were some real investigative reporters out there like Woodward and Bernstein who would break this story to a newspaper that was truly trying to get to the heart of the matter. I am cynical in that I believe a reporter and a paper interested in the truth and promulgating it is a thing of the past. I served in our military and swore to defend our constitution against all enemies foreign and domestic, and these people in office ,or aspiring to advance their political careers ,could give a rat’s a__ about our constitutional rights or us. I for one am getting very frustrated over this whole Democratic debacle and I’m mad as hell.

Can anyone logically explain why its to Obama’s advantage to go through all the legal action rather than to supply the documents, unless he actually can not supply the documents
The only possible advantage of witholding the documents, assuming he actually has them, is of getting Mcain or some other high-profile Republican to call him on it, loudly, and then go, ‘But of course!’ and suddenly produce them, making a fool of his accuser in the process.
That’s the only reason I can think of. Not saying I think that’s the case, though.
In the end, it staggers me that unequivocal proof of citizenship is not something that must be provided before running as a valid candidate.
At the very least, there should be a ceremonial (but legal) proof of citizenship before an elected President can be sworn in.
From what I understand of the law governing Natural Born Citizenship, Barack Obama is not eligible to be sworn in as President of the United States.
So why are the democrats going to all this trouble to get a man elected who does not meet the eligiblity requirements?

This is pathetic. Obama’s Certificate of Life Birth is proof that he was born in Hawaii.
Obviously if Obama had a real birth certificate he would have produced one like John McCain.

Has it been proven that the COLB which Obama provided is a fraud? And, is there a way to have that particular “fraudulent” COLB examined by an independent (non-partisan) analyst? BTW, my spouse who works for USDOS (visas- 20 years) states that the case against Obama is not going to work.
I wish that he would leave a message to cite his reason(s) which were given to me. I don’t fully understand his explanations. He cited several sections from the Immigration and Nationality Act reference guide, yet I am still unsure I fully understand.
The fake COLB is certainly interesting and consistent with a pattern of deception and diversions. However, if you read all of Berg’s arguments, you understand that Obama becoming an Indonesian citizen and providing no proof of a subsequent pledge of allegiance to the US is the “show stopper”. Obama’s Indonesian citizenship is heavily documented.
I blame the DNC for not producing records. If they have it, why not show it. It tells me they have no records for their candidate for President of the United States. Obama won’t let any of his records be told. None from his college or as a lawyer. This is abuse of power. Keep at this. Bug them and get the message out on the media. The media will get the answer. Get FOX ON IT NOW.
