“Well this was an unexpected turn of events. As a result of their
negligence in Answering or otherwise entering an appearance in Superior
Court, a series of events are unfolding that could result in profound
changes in the Vermont Primary this March. What those changes will be is
difficult to predict. There are structural and legal problems with Vermont
Election Laws (Title 17) which has been thrown together “piecemeal” over
the years and this case should focus attention on the shortcomings of the
current law.
Mr. Paige visited the Secretary of State’s Office today to hand deliver a
copy of the latest filings that requested a Temporary Restraining Order to
prevent the “publication and distribution” of the Presidential Primary
Ballots until the “troubles” complained in the Plaintiff’s pleadings are
resolved or an accommodation can be found that would avoid injuring or
disenfranchising the various candidates.
Sadly, the Attorney General’s office has failed to inform the Secretary of
State’s Election Office of their failure to respond in Superior Court. The
Director of Elections appeared “shell shocked” as Mr. Paige filled him in
on the case, the default and the resolution he intends to propose to the
Court relating to the Primary. The General Election and the “natural-born
Citizen” question will require additional consideration in order to find
an equable resolution which hopefully will include defining “nbC”
precisely as part of the ruling (rather than mere dicta unrelated to the
resolution).
Mr. Paige informs that the gross negligence of the Defendants exhibited by
their failure to respond reduces the A/G opportunities to stall and
“sidetrack” the case. The expedited resolution of the questions relating
to the Primary could produce an interesting civics lesson for Vermont
voters.

The matter, he said, must be urgently addressed.
“The entire nation cannot afford such constitutional confusion and uncertainties overhanging the electorate process,” Mr. Schwartz, who lives and practices law in Mr. Cruz’s home state of Texas, wrote in the 73-page lawsuit.”

Donald Trump is actually right about something: Sen. Ted Cruz (R-Tex.) is not a natural-born citizen and therefore is not eligible to be president or vice president of the United States.
The Constitution provides that “No person except a natural born Citizen . . . shall be eligible to the Office of President.” The concept of “natural born” comes from common law, and it is that law the Supreme Court has said we must turn to for the concept’s definition. On this subject, common law is clear and unambiguous. The 18th-century English jurist William Blackstone, the preeminent authority on it, declared natural-born citizens are “such as are born within the dominions of the crown of England,” while aliens are “such as are born out of it.” The key to this division is the assumption of allegiance to one’s country of birth. The Americans who drafted the Constitution adopted this principle for the United States. James Madison, known as the “father of the Constitution,” stated, “It is an established maxim that birth is a criterion of allegiance. . . . [And] place is the most certain criterion; it is what applies in the United States.”
Cruz is, of course, a U.S. citizen. As he was born in Canada, he is not natural-born. His mother, however, is an American, and Congress has provided by statute for the naturalization of children born abroad to citizens. Because of the senator’s parentage, he did not have to follow the lengthy naturalization process that aliens without American parents must undergo. Instead, Cruz was naturalized at birth. Wong Kim Ark, the Constitution “contemplates two sources of citizenship, and two only: birth and naturalization.” Unless born in the United States, a person “can only become a citizen by being naturalized . . . by authority of congress, exercised either by declaring certain classes of persons to be citizens, as in the enactments conferring citizenship upon foreign-born children of citizens, or by enabling foreigners individually to become citizens . . . .” A person granted citizenship by birth outside the United States to citizen parents is naturalized at birth; he or she is both a citizen by birth and a naturalized citizen. This last point is discussed thoroughly in Jill A. Pryor’s 1988 note in the Yale Law Journal, The Natural-Born Citizen Clause and Presidential Eligibility: An Approach for Resolving Two Hundred Years of Uncertainty.
The Supreme Court holds that the citizenship statutes are exclusive; there is no residual common-law or natural-law citizenship. Citizens have no constitutional right to transmit their citizenship to children. In Rogers, the Supreme Court upheld a statute requiring children born overseas to citizen parents to reside in the United States to retain their citizenship. Since “Congress may withhold citizenship from persons” born overseas to citizen parents or “deny [them] citizenship outright,” it could impose the lesser burden of requiring U.S. residence to retain citizenship.
Congressional power to withhold citizenship from children of U.S. citizens is not hypothetical; for decades, it was law, and to some extent still is. The Tribe-Olson Opinion proposes that “[i]t goes without saying that the Framers did not intend to exclude a person from the office of the President simply because he or she was born to U.S. citizens serving in the U.S. military outside of the continental United States . . . .” However, the Seventh Congress, which included Framers Gouverneur Morris and Abraham Baldwin among others, did precisely that. In 1961 in Montana v. Kennedy, the Supreme Court construed an 1802 statute to mean that “[f]oreign-born children of persons who became American citizens between April 14, 1802 and 1854, were aliens . . . .” Thus, children of members of the armed forces serving overseas, and diplomats and civil servants in foreign posts, were not only not natural born citizens eligible to be president, they were not citizens at all.
Denial of automatic citizenship had very different implications than it would now because until the late nineteenth century, there was little federal immigration law. There were no general federal restrictions on who could enter the country, no provisions for deportation of residents who became undesirable, and immigration officials to deport them. Of course, these children could become citizens by individual naturalization. But even if the child suffered based on lack of citizenship, according to the 1907 Supreme Court decision in Zartarian v. Billings, “[a]s this subject is entirely within congressional control, the matter must rest there; it is only for the courts to apply the law as they find it.””

Most of the time people who do not understand STRONG CHARACTER in a person will try to knock holes in such a person’s esteem with HATEFUL, and otherwise degrading insults………..in truth the insulters have NOTHING to base their hate on, and in reality they do this because they dislike what he represents…………which in truth is totally the opposite of what such simple minded people purport to be their primary concerns, regarding people like Trump. Simple minded people think EVERYTHING should be GIFT WRAPPED, and tied with a neat little bow,and HANDED TO THEM……….they do not want to lift a finger to help themselves much less venture to do something CONSTRUCTIVE ON THEIR OWN………..they are too busy doing their own VICES. We have far too many simple minded people in America, and simple minded people BEGET more simple minded people.
I hold great admiration of Trump. It is clear to me that he largely built his empire by himself. I respect that. I too throughout my life done everything that was necessary MYSELF. But unlike Trump I had the HELP of a dear personal friend who happened to be an attorney as well. It was largely his understanding of contract language which earned us the status of primary printed material contractor for Project 1516 of the Defense Logistics Services. We did NOT MAKE A MILLION DOLLARS for ourselves, but we did earn a living by providing the DOD printed material. We had a great deal of money invested in both production machinery, and in the real estate, under the roof of which was our Commercial printing company. I respect Trump because I too know what it takes to be successful in business, and a hell of a lot of what your UNION employees try to pass off as the truth, is largely BULLSHI#. GROSS RECEIPTS for 1 year is NOT NET PROFITS………like so many of the big mouth union leaders try to make people believe is the truth. Government contracts have a hell of a lot of potential stumbling blocks written into the language, and such stumbling blocks will very often be the final arbiter of profit or loss. We put our money into it and relied upon OURSELVES to EARN A PROFIT at the end of the day! We didn’t screw our employees. We treated them exactly as we told them we would. We HIRED some and we FIRED some, ….again which is par for the course we call BUSINESS! NOW YOU KNOW THE PRIMARY REASON WHY TRUMP HAS AT THIS POINT IN TIME MY FAITH.

WHY now are we asking these good questions of Cruz (and by the way, I’m not voting for him), but 8 years ago, we were not allowed to ask them of Obama…..who by the way has NEVER, to this date produced any documentation of proof of anything; The day he took office, he purposefully sealed everything that would identify exactly who he was and where he came from……and America let him do it. Here is what we DON’T know and don’t have;
a. A VALID birth certificate proving he was even born…anywhere.
b. a VALID Social Security Number…and not one of the man who was born in 1890’s
c. any school records from any college or university he supposedly attended… not even valid grade school records.
d. Any proof that he has ever PASSED a security check to hold a TOP SECRET clearance giving him authority to put his finger on the nuke trigger,….. or even be qualified as a security guard at Walmart..
e. Any proof that his two children were birthed by the Mooch.
f. Any proof that he was indeed a LAW PROFESSOR as he claims, and the real Law Professors in Chicago publicly challenge..
For the past 8 years, America has been forced to live under a very dark cloud with absolutely NO KNOWLEDGE of who, where he came from, or what their leader really is, or ever was…that is not good….
As far as we know, he could have been, and most likely was, born under a rock…somewhere.

The white American’s who bought into this grand scheme, hook,line and sinker, by saying that “we need a black president” in order to be politically correct and shake off “our white guilt”, or will it be the black people of America who were crying with joy, dancing in the streets, and standing in line waiting for all that “free Obama stuff” which he promised but still hasn’t materalized ?
There is an age old axiom that says….”The truth about anything can never be hidden forever” ….I believe this with all my heart and soul.
The truth will come out and I predict it will be very nasty.

Will Congress play dumb-ass as usual and say if they had only have known all the facts about Obama our country would not be in the sad state it is in today? Will they hold massive hearings and vow that the skull-dugerry things Obama committed while in office will never happen again in America ….although most of them stood by silently while he disassembled our nation, one block at a time…actually, most of them even actually helped him in that process.
And what of the white people of America that saw this coming like a runaway train without an engineer on board…what will be their comments and positions? Will they shout from the roof tops, “I TOLD YOU SO”, or will they rise up in arms against those who keep this charade alive for 8 long hard years?
Will the people sharpen pitchforks and knives and go hunting?
Anyone with even the smallest of brains must admit this country has suffered under Obama inability to lead, let alone his legality to lead…
We still have almost 11 months to go on this term of office. his Chief-of-Staff has promised more ‘Executive Actions” on things that will continue to hurt America …He calls them “Executive Actions” rather than Executive Orders”, because he feel he will have no responsibility for them after he is out of office.
America is now waking up to some hard realities, thanks to Donald Trump….it will be a very bumpy 11 months, but there are those real American’s who are willing to defy Obama for America’s sake…thank God for that.

I used to think that a person was a natural born citizen if he was born in the United States. However, through my interest in genealogy, I came to the understanding that persons born on American soil, are NATIVE born. You are NATURAL BORN if one or both of your parents has American citizenship. A NATURALIZED CITIZEN is an alien who has applied for citizenship and completed the naturalization process, which could take years.
Apparently there are conflicting opinions by legal scholars as to the definition of “natural born citizen”. Unfortunately, it will be up to the courts to make the determination. If it goes to the Supreme Court and they agree with Puzzo, that both parents must be American citizens, then Obama is not eligible to be President. Can someone tell me what happens to our country then? What happens to the laws he signed? Are they all declared invalid? Or do they have to be litigated individually? I’m anticipating chaos.

oldsoldier, If Trump’s mother became a naturalized citizen before Donald was born in 1946, then Trump is a natural born citizen. If not, then Donald is NOT eligible to be President. According to Puzzo and other legal scholars, both parents must be citizens at the time of birth. I saw a document for Mary Anne Trump at WND but it is a just receipt…….
Receipt in National Archives of Mary Anne Trump’s naturalization dated March 10, 1942, four years before she gave birth to Donald Trump.
