“REPLY BRIEF FOR THE PETITIONER

1. This case is, and has been from the start, fundamentally about where to draw the line between lawful political activity and crimes of extortion, bribery and honest services fraud. That is an important issue of bipartisan concern, directly impacting all candidates seeking or holding public office and their supporters, and one which this Court recently agreed to review in McDonnell v. United States, No. 15-474 (certiorari granted Jan. 15, 2016). Blagojevich’s case is particularly important because it involves only the solicitation or attempt to obtain campaign contributions, which this Court has held are a form of protected political speech that warrants heightened scrutiny. Indeed, regardless of one’s views about money in politics, a bright-line rule distinguishing lawful campaign fundraising activities from unlawful political corruption is necessary to avert a chilling effect on candidates’ First Amendment right to solicit (and receive) campaign contributions, and donors’ First Amendment right to respond with contributions. Clarity about where to draw that line is also essential to avoiding arbitrary and discriminatory enforcement against politicians who are outspoken, controversial, polarizing or simply unpopular. It is an issue that impacts our longstanding system of private financing of election campaigns from President of the United States to local alderman, and one that the lower courts have struggled with consistently since Evans v. United States, 504 U.S. 255 (1992).”

“2. The government’s opposition does not dispute that the lower courts have expressed confusion—and signaled the need for further clarity and guidance from this Court—regarding what effect Evans had on McCormick v. United States, 500 U.S. 257 (1991), in the context of public corruption prosecutions involving the solicitation of campaign contributions. To the contrary, the government’s attempt to minimize the degree of conflict among the circuit courts on this issue (Opp. 18-21) proves the essence of Blagojevich’s petition: that the lower courts have acknowledged a significant lack of clarity regarding whether Evans modified or relaxed McCormick’s “explicit promise or undertaking” requirement to prove public corruption offenses involving campaign contributions; that the confusion arises in part from uncertainty regarding whether this Court’s holding in Evans was meant to weaken the requirement for proving extortion involving campaign contributions; and that the circuits have expressed particular confusion about what McCormick’s requirement that a quid pro quo be “explicit” means in light of Evans. The government also concedes (Opp. 20) that since Evans some courts of appeals have (appropriately) recognized the distinction between public corruption cases involving campaign contributions and those involving other payments, and have indicated or suggested that extortion cases involving campaign contributions require heightened proof of an “explicit” agreement under McCormick. ”

I see such societal control, or government if you will very much like the pendulum of a grandfather clock. If the pendulum over travels the escapement can be damaged, or if it under travels the escapement will not function as designed, and the pendulum will cease to swing in either direction. It all rests upon the adjustment of the crutch. By comparison Orwell’s doctrine is a failed escapement. Simply because the words that he has uttered is that of his own twisted logic……..as was the case with the Nazi party of Germany. Their idiom became their vernacular. The swing of their pendulum was SYNTHETIC, and therefore USELESS, and the swing of their pendulum finally ceased altogether.

    In 2011 Tony Rezko was sentenced to 10.5 years in prison for a kickback scheme that involved the Teacher’s union.

    On Tuesday Tony Rezko was released from prison and transferred to a halfway house.
    The AP “forgot” to mention that he was connected to Barack Obama.

    Antoin “Tony” Rezko was convicted in 2008 of fraud, money laundering and plotting to squeeze more than $7 million from companies seeking to do state business during Blagojevich’s tenure. Rezko was sentenced to 10 1/2 years in prison. He was also serving time for fraud over the bogus sale of his pizza restaurants.

    U.S. Bureau of Prisons Ed Ross says Rezko was furloughed Tuesday from the Federal Correctional Center in Pekin to a halfway house outside Chicago.

    Rezko attorney Joe Duffy told the Chicago Tribune the Bureau of Prisons concluded Rezko had been a model prisoner and released him “so he can start transitioning back into society.”

On the internet magazine HighTimes.com they express that U.S. Senator Bernie Sanders is receiving, or being offered, campaign donations from sellers of marijuana in states that allow the sales of marijuana. They are indicating that 10% of the sale of marijuana “joints” are being donated to the 2016 political campaign of United States Senator Bernie Sanders.

    One target of Trump has been his hotel competitors, who import towels and other merchandise from Mexico, Japan, China, and elsewhere.

    The criticism has been so serious, that Marriott Hotels just made an incredible announcement! From now on, all their towels will be made in America, by American workers!

    Trump isn’t even in the White House, and he’s already having a major impact on America’s economy…

    From now on, all towels made for Marriott International’s nearly 3,000 hotels in the USA will be made in the USA.
    Marriott announced on Thursday that it will have only “Made in the USA” towels and bath mats in every guest bathroom.

    The Bethesda, Md.-based hospitality giant has partnered with Standard Textile, which has factories in Thomaston, Ga., and Union, S.C., to produce the towels and bath mats with 100% cotton fiber grown in the USA. Standard Textile says the partnership will produce 150 jobs.

    Previously, Marriott’s terry cloths were made in Jordan.

    “If you can bring 150 jobs back to the USA and we can put on all our towels and bath mats ‘Made in the USA,’ I think that gives a certain amount of pride to all of our associates and management,” Bill Marriott, chairman of the Board of Marriott, said during his flight to tour both plants on Thursday.

    All its brands from the Courtyard Marriott to the Ritz-Carlton will participate in the new program.

    Marriott Hotels should be applauded for standing with the American workers and agreeing with Donald Trump.

    ………..yes the corporations that left America did so for a reason which was largely the cumulative effect of corporate taxation, the high cost of labor, and the ever increasing cost of materials. When compounded these factors by themselves are enough to negate margin…….NO MARGIN =NO PROFIT= no incentive to remain in business, or in the US. Apple left for the same reasons, and so did hundreds other larger corporations. There are limiting factors in every American product whether that product produces a profit or not. Like it or not we must remain competitive in the marketplace otherwise we are dead in the water, and might as well close up. When organized labor takes over a manufacturing facility, the days of that company become numbered. MORE,MORE,MORE can be tolerated only for a certain length of time. When there is no longer profitability as was the case with Chrysler Corp. and a host of prior auto manufacturers they closed up. The demise of such companies as Studebaker, Packard, and others was more than likely the effect of a COMBINATION of factors, but not necessarily labor cost alone. There must also be a market for the product of a company. When the cost to manufacture a product exceeds what the buying public can afford, or is willing to pay for it, the manufacturer will soon be facing bankruptcy, particularly if he is relying upon one product alone for his sales.
    All I am saying is that there needs to be a top wage established in American business that can be paid to an employee. The employees have an obligation to themselves to live within their means. All too many young people see what their parents have spent a lifetime acquiring, and they want everything their parents have literally OVERNIGHT……….which is why so many young people end up in BANKRUPTCY. They cannot control their spending habits……..then they want to blame their employers for their financial dilemmas, and end up going on strike for MORE, then a few years later, MORE, then a few years after that even MORE. Where does it end? It usually ends in the employees striking themselves out of a job when their employer decides to shut down. Just my viewpoint!

    Nabisco to move Oreo’s plant to Mexico, loss of over 600 jobs!

    I may have to give up one of my longest-standing indulgences: the dunking of an Oreo cookie in cold milk (whole is preferred). I don’t do this lightly, as I have been dunking those deliciously wicked rounds of chocolate and what I choose to believe is cream since I’ve been three.

    Why give them up? Because this week, Irene Rosenfeld, the head of Mondolez (the food conglomerate based in Illinois that has Nabisco in its portfolio), a woman touted for breaking the glass ceiling upon becoming the head of Kraft Foods and then its spin off, announced that rather than invest $130 million in modernizing the plant in Chicago, where Oreos have been lovingly produced for the past 100 years, she will instead move the jobs to a new factory in Mexico. The result: a loss of 600 well-paying and community-sustaining jobs on Chicago’s Southwest Side.

    Is giving up Oreos a foolish and futile gesture? Of course, I know that other Chicago-born companies have made similar moves. I, like many Chicagoans felt a loss when Frango Mints were no longer hand made on the top floor of Marshall Field’s—and felt worse when Marshall Field’s ceased to exist at all. I was saddened when Klaus Suchard chose to take Brach candy production from Chicago, and in so doing ended Chicago’s title as candy capital of the world. I even regretted the loss of the city’s steel mills and stockyards, despite the cleaner air that their exodus brought.

    “Operation Choke Point”

    The Justice Department’s “Operation Choke Point” initiative has been shrouded in secrecy, but now it is starting to come to light. I first heard about the program in January through this article and since then it has been difficult to discover details about it. It is so named because through strangling the providers of financial services to the targeted industries, the government can “choke off” the oxygen (money) needed for these industries to survive. Without an ability to process payments, the businesses — especially online vendors — cannot survive.

    The general outline is the DOJ and bank regulators are putting the screws to banks and other third-party payment processors to refuse banking services to companies and industries that are deemed to pose a “reputation risk” to the bank. Most controversially, the list of dubious industries is populated by enterprises that are entirely, or at least generally, legal. Tom Blumer’s extremely informative post summarizing what is known to date about Operation Choke Point reproduces the list, which includes things such as ammunition sales, escort services, get-quick-rich schemes, on-line gambling, “racist materials” and payday loans. Quite obviously, some of these things are not like the other; moreover, just because there are some bad apples within a legal industry doesn’t justify effectively destroying a legal industry through secret executive fiat.

    Especially ironic, of course, is that while the DOJ and bank regulators are choking off financial services to legal industries, they are also encouraging banks to provide banking services to illegal marijuana sales.

    The ability to destroy legal industries through secret actions to deprive them of banking services has obvious political consequences. For example, it was reported last week that firearms shops are alleging that Operation Choke Point is being used to pressure banks into refusing to providing financial services. There are also reports that porn stars (and here) have had their bank accounts terminated for “moral” reasons related to the “reputation risk” of banking individuals in the porn industry. IRS officials must already be salivating about ways to apply Operation Choke Point to tea party groups.

    In principle, of course, the logic of Operation Choke Point could be extended to groups not currently targeted. Notably absent from the FDIC’s hit list, for example, are abortion clinics, radical environmental groups, or, well, marijuana shops, for that matter. Something similar was done to cut off credit-card payments to support the operation of WikiLeaks.

    The larger legal and regulatory issue here is the expansive use of the vague and subjective standard of “reputation risk” to target these industries. In a letter to Janet Yellen, the chair of the Federal Reserve, last week, House Financial Services Committee Chairman Jeb Hensarling expressed concern over the growing use of “reputation risk” as a vehicle for attacking legal businesses. Is there any discernible principle as to why, for example, a payday lender or firearms dealer poses a “reputation risk” and an abortion provider does not?

    So far, one of the porn stars has sued to try to determine why his loan application was denied. Given that Operation Choke Point seems to be doing exactly what was its alleged intent — to choke the life out of the businesses in the covered industries — I expect more lawsuits to come that will shed some light on this initiative.

    We’ve just learned more about the man. File this in the category of #ShockingNotShocking. Thomas Dimassimo turns out to be a “professional” protester with a history of anti-American behavior.

    The Secret Service released the name of the man arrested this morning for bum rushing the stage in Ohio to attack Donald Trump. He is 32 year old [sic – other reports note he is 22] Tom Dimassimo and he first came to national attention for holding “a protest” where students stepped on the American flag on the grounds of Ohio’s Wright State University…

    Here he is dragging the flag around like a piece of garbage.

    NBC News reports Dimassimo was charged with disorderly conduct and inducing panic — both misdemeanors — according to Chief Mike Etter of the Dayton Airport Police Department.

    When you see the likes of Dimassimo in action, trashing the American flag and attempting to rush an unabashedly American presidential candidate, you might understand what some are labeling as nationalist sentiment from Trump supporters.

    Whether you are a Trump supporter or not, those of us who remain committed to core American principles can all agree this man’s anti-American actions are disgraceful.
