“Lawyers for Bill Cellini ask for new trial because of juror”
“Lawyers for convicted Springfield power broker William Cellini filed for a new trial Monday based on information first revealed by the Tribune that a juror apparently concealed two felony convictions from court officials during jury selection.
The 21-page motion argued that the juror — whose name was blacked out — deliberately lied under oath on separate questionnaires and again under questioning in court by failing to disclose convictions for crack-cocaine possession in 2000 and aggravated driving under the influence in 2008, both felonies.
The motion points out that the government’s key witness, political insider Stuart Levine, admitted on the witness stand to three decades of abusing cocaine and other drugs, which the defense used to attack the government’s case.
“(The juror’s) criminal history and drug conviction, in particular, would have been critical information if revealed during the selection process, given that a key component of the testimony and credibility of Stuart Levine concerned his own criminal history and his years of drug abuse and distribution,” the defense filing said.
The filing also cited the words of federal prosecutors in former Gov. George Ryan’s trial when, under similar circumstances, they argued to remove two jurors during deliberations in 2006 after the Tribune reported they had apparently concealed their arrest records.
“From the moment this issue surfaced (in the Ryan trial) … the government took the position that the jurors’ dishonesty demonstrated bias and warranted removal,” Monday’s motion said.
The defense also argued that the juror violated her probation in the drug case and failed to pay the $1,395 fine levied in her DUI conviction, disqualifying her from serving on a federal jury because her civil rights had not been restored.
Randall Samborn, a spokesman for the U.S. attorney’s office, declined to comment Monday night on the filing.
Some experts have told the Tribune that undoing a jury verdict would be no easy task, even if the judge determines that the juror was untruthful.”

I like Ron Paul overall… but let’s not act like he (or any of them) stand for principle (like the founding father, esp Patrick Henry)… he’s another career politician looking to grab as much personal power and glory as possible.
Even so, he’s probably closer to a principled conservative than anyone else in the race.
Ron Paul says obama is legal, and case is closed.
He is good on economy/health care and most domestic issues.
HE is an utter moron on foreign policy and on the wrong side of global cooling..i mean global warming…i mean global cooking…i mean climate change.
He would make a very poor president.
I would like the GOP to come up with another debate format. Otherwise, allowing liberal moderators from the press to ask liberal gotcha questions during the debates allows the liberals to frame who should be the nominee. I liked the Cain, Gingrich format that allows GOP moderators to ask the questions, but of course more candidates would have to be included.

It fascinates me that Occupiers hate the rich cats unless they help finance their cause or rally at their sides, like George Soros and Michael Moore.
It prompts one to wonder: Why haven’t such power relations been reported by the MSM? And would they be so silent if the correlations were between such agents of control and the tea party?
For example, even with its liberal bent, Snopes.com just verified last Thursday that Vice President Joe Biden’s attorney son, Robert Hunter Biden, was retained for years to “undertake some lobbying efforts on behalf of Brookfield Office Properties,” which just happens to own Zuccotti Park in New York, where the Occupiers rally their national movement.
Snopes.com also verified that New York Mayor Michael Bloomberg’s live-in girlfriend, Diana L. Taylor, is on the board of directors of Brookfield Office Properties.
And just two months ago in September, the federal government’s Department of Energy guaranteed a stimulus “loan” of $168.9 million to Brookfield Asset Management, which is a parent company of Brookfield Office Properties.
But I’m sure those local and Washington governmental associations with Occupy Wall Street are all just coincidental and inconsequential, right?

“Eric Holder’s former chief of staff, Kevin Ohlson, would like to be confirmed to the U.S. Court of Appeals for the Armed Forces — but some senators — chief among them John McCain — want to know what he knew about Operation Fast and Furious before they’ll grant him their stamp of approval.
Not surprisingly, Ohlson claims he knew nothing, even though he worked with Holder from January 2009 to January 2011 and received routine courtesy copies of weekly reports that referred to Fast and Furious by name.
McCain last week sent a letter to Ohlson pointing out the obvious — that, as Holder’s chief of staff, Ohlson was in a position not only to be informed about the calamitous gunwalking program, but also to know what information did or did not reach Holder himself.
Ohlson responded to McCain’s letter yesterday with predictable excuses for his purported ignorance of the details of the program that effectively caused the death of Border Patrol Agent Brian Terry:
But in his response, Ohlson wrote he had “been informed that routine courtesy copies of weekly reports were forwarded to me that referred to the operation by name, but that did not provide any operational details and did not refer to gun walking or anything similar.”
But Ohlson said nothing on the cover sheets of the reports indicated they contained important or sensitive materials and he didn’t review them.
Ohlson clearly takes after his boss, who has openly admitted to not reading important memos about the operation. It’s a troubling trend, as it either indicates that these DOJ officials did know about F&F and implicitly endorsed it OR that busy work has so overcome government officials that they have no time to explore significant operations.
The Senate is right to take Ohlson’s upcoming confirmation hearing — slated for Thursday — seriously: What of Ohlson’s incompetence at DOJ suggests he’d be a thorough and conscientious judge on the U.S. Court of Appeals for the Armed Services? It’s bad enough that, when Ohlson moved out of the position of Holder’s chief of staff, he moved into the position of head of the DOJ’s professional misconduct review unit.”

Poll: Ron Paul claims front runner status, soaring past Gingrich, Romney | The Raw Story
A surprising new poll out of Bloomberg News on Tuesday morning found that former House Speaker Newt Gingrich (R-GA) is not the only Republican to benefit from the seeming demise of other prior frontrunners.
Beating all the odds and the pundits’ expectations, Rep. Ron Paul (R-TX) has emerged as one of the new frontrunners in the crucial Iowa primary for the GOP nomination to the presidency, topping even Gingrich and former Mass. Gov. Mitt Romney and virtually tying former businessman Herman Cain for the lead.
All surveys counted, Bloomberg News found that Paul has the support of 19 percent of the state’s GOP primary voters, versus Cain’s 20, Romney’s 18 and Gingrich’s 17.
It’s just the latest in a string of small victories for Paul, who won a Calif. straw poll in Sept., an Ohio straw poll in Oct. and an Illinois straw poll earlier this month. He also dominated a CBS News viewer survey this week, which asked who won the last GOP debate and who should win the nomination. Paul topped all the other candidates by tens of thousands of votes, even though he was only given 89 seconds during the entire debate to speak.

“Relax, Jim Treacher tells us. Everyone knows that the Obama administration has been scandal-free, except, y’know … for the scandals. Hot on the heels of the Washington Post bombshell on Solyndra, the Daily Caller’s Matthew Boyle discovers that the Department of Justice apparently withheld information requested by Senator Charles Grassley on a Bush-era operation involving gun tracking in order to drop it in selected media leaks to make the Operation Fast and Furious investigation look partisan in nature:
Attorney General Eric Holder’s Justice Department sought to manipulate reporters’ coverage of Operation Fast and Furious during the days preceding a November 1 Senate Judiciary Committee hearing, new emails obtained by The Daily Caller indicate.
Emails between senior Justice Department officials and investigators in the office of Iowa Republican Sen. Chuck Grassley show that congressional staffers leading the investigation into Operation Fast and Furious requested information about Operation Wide Receiver — a Bush administration program – and other similar cases, more than a full month before the DOJ leaked information to selected media outlets on October 31.
Grassley had asked Holder for information specific to Wide Receiver, although the excerpts Boyle uses don’t show Grassley using the operation name. The request itself asked for information on earlier operations in the Bush administration that had resulted in lost guns, specifically due to failure of intended interdiction by Mexican authorities. That underscored the glaring differences between Wide Receiver and Fast and Furious, differences that Senator John Cornyn forced Holder to acknowledge in testimony last week — that the Bush administration had conducted its operation with the full knowledge and cooperation of the Mexican government and that the Bush administration actually tracked the weapons, unlike the ATF in F&F.
Despite having asked for this data weeks earlier, the DoJ withheld it from Grassley until October 31st — but not before leaking it to friendly media in a manner that obscured those key differences:
Instead, the Justice Department held the information and related documents until the night before Assistant Attorney General Lanny Breuer was scheduled to testify before the Senate Judiciary Committee.
Those documents showed Breuer was at least partially responsible for Fast and Furious. Breuer subsequently issued a statement apologizing for not stopping the ATF agents leading Fast and Furious from implementing the same failed tactics used in Operation Wide Receiver — information he confirmed he had in April 2010.
The DOJ selectively picked which news outlets received the leaked documents, and which documents were released.
Well, it’s no big deal, right? It’s not as if this is a life-and-death issue. Oh, wait …
Scandal-free, my foot. If this administration had nothing to hide, it wouldn’t be so desperate to manipulate the media and dodge Congressional oversight. It’s long past time for Eric Holder to resign. It might be time for the Senate to block all Obama nominees until he fires Holder.”

The U.S. Supreme Court will hear a challenge to President Barack Obama’s sweeping health care reform law, the court announced Monday. Oral arguments will likely be held in late February or March, with a ruling by June. A key issue to be considered by the high court’s nine justices is whether the “individual mandate” section of the law — requiring nearly all Americans to buy health insurance by 2014 or face financial penalties — is an improper exercise of federal authority. Various states have argued that if that linchpin provision is found unconstitutional, the entire law will have to be scrapped.

The Examiner’s Philip Klein, who’s established himself as something of an Obamacare maven, calls today’s developments “great news” for the law’s foes:
This is great news for opponents of Obamacare, because the case, which comes out of the 11th Circuit of Appeals, is the best briefed and best argued of all of the various legal challenges to the health care law. It’s the case that opponents of the law won at both the district court and appellate level.
Former solicitor general Paul Clement and Michael Carvin of Jones Day (who also has lots of experience before the Supreme Court) did a masterful job arguing the case before the 11th circuit. Georgetown Law Professor and constitutional law whiz Randy Barnett is also an advisor to the NFIB on the suit. Until we have an actual decision by early next summer, legal experts will spend months speculating on how the the court will ultimately rule. But opponents of the law should be heartened that they’ll at least have their A-team handling the case.
Also, the court will weigh four major issues — the Constitutionality of the individual mandate, whether the mandate can be “severed” from the rest of the law if it’s nullified, jurisdictional questions, and whether the law’s Medicaid expansion places an undue and unconstitutional burden on the states:”

“THE CASE FOR RON PAUL”

“Ron Paul is a practicing Baptist, and has been married to the same woman for over fifty years. He has five children and over a dozen grandchildren. There can be no better example of a man with family values.
Due to some of his disagreements with the Republican Party, some have been quick to accuse him of not being conservative. This accusation has no legs to stand on, and the biggest evidence to show for that is his record. In twelve congressional terms, Paul has never voted to increase taxes, has never voted for a congressional pay raise, and has never voted for an unbalanced budget.
One would be hard pressed to find a more fiscally conservative individual.
One of the most ludicrous accusations against Dr. Paul is his supposed stance of being anti-Israel. This was most likely due to statements he has made saying that the United States should cease sending Israel foreign aid. The thing is, Ron Paul supports ending foreign aid to all nations. This would actually put Israel in a better position than they’re in right now. We currently give Israel’s enemies three times as much aid as we give Israel. By ending all foreign aid, we stop helping Israel’s enemies, and they’ll begin to grow less dependent.
What could be more pro-Israel than that?
It’s no secret that the economy and the debt will be the two largest issues in 2012, and Ron Paul has the most credibility on both issues. Back in September of 2003 he predicted the housing crash that would eventually occur in 2007, which led to the financial recession. This should convince most voters that he knows what he’s talking about. As for the debt, Ron Paul never votes for an unbalanced budget, so it can only be assumed that he would veto one as well. He would decrease spending and cut whole departments; something that most Republicans don’t have the political guts to do. These policies would go a long way towards shrinking the debt to at more manageable size.
While not the conventional politician, this may work to Dr. Paul’s advantage. People seem to be sick and tired of both Republicans and Democrats and are clamoring for something new.
Even with monumental gains in 2010, Republicans were not elected because they were liked. They were elected because they were not Democrats. People are longing for a change of the status quo, and Ron Paul can give it to them. Although some conservatives might be uncomfortable with a libertarian minded Republican, they would do well to listen to the philosophy of Ronald Reagan who once said, ‘I believe the very heart and soul of conservatism is libertarianism.’”

When I was young, a Republican, Henry Kissinger as Sos, was considered brilliant. Not since then, have we had someone considered brilliant In the GOP, with the exception of Condi Rice. Now you may argue with their opinions. However, I would love to see a brilliant GOP again. Gingrich, Santorum, Romney and Huntsman all come across that way. It has been hard for the media to portray them as dumb because they are not.
Starla, when RAND Paul considers a run I’ll consider Paul. I just can’t get that fired up about RON.
