PRESS STATEMENT OF FCC COMMISSIONER AJIT PAI

ON PRESIDENT OBAMA’S PLAN TO REGULATE THE INTERNET

The American people are being misled about President Obama’s plan to regulate the Internet.
Last week’s carefully stage-managed rollout was designed to downplay the plan’s massive intrusion into the Internet economy and to shield many critical details from the public. Indeed, Chairman Wheeler has made it clear that he will not release the document to the public even though federal law authorizes him to
do so.
I believe the public has a right to know what its government is doing, particularly when it comes to something as important as Internet regulation. I have studied the 332-page plan in detail, and it is worse than I had imagined. So today, I want to correct the record and explain key aspects of what President Obama’s plan will actually do.

First

, the claim that President Obama’s plan to regulate the Internet does not include rate regulation is flat-out false. The plan clearly states that the FCC can regulate the rates that Internet service providers charge for broadband Internet access, for interconnection, for transit—in short, for the
core aspects of Internet services. To be sure, the plan says that the FCC will not engage in what it calls ex ante rate regulation. But this only means that the FCC won’t set rates ahead of time. The plan repeatedly states that the FCC will apply sections 201 and 202 of the Communications Act, including their rate
regulation provisions, to determine whether the prices charged by broadband providers are “unjust or unreasonable.” The plan also repeatedly invites complaints about section 201 and 202 violations from end-users and edge providers alike. Thus, for the first time, the FCC would claim the power to declare broadband Internet rates and charges unreasonable after the fact. Indeed, the only limit on the FCC’s discretion to regulate rates is its own determination of whether rates are “just and reasonable,” which isn’t
much of a restriction at all.
Lest anyone take comfort in the notion that the FCC will allow the market to set prices through competition, the plan goes out of its way to reiterate its view that competition is limited. And it uses the FCC’s new 25 Mbps yardstick for broadband to claim that competition doesn’t exist for a majority of
Americans. To think that rate regulation and other utility-style regulation will not happen in the face of such findings is naïve.

Second

, President Obama’s plan targets pro-competitive broadband service offerings, both actual and potential, that benefit consumers. The plan expressly states that usage-based pricing, data allowances—really, any offers other than an unlimited, all-you-can-eat data plan—are now subject to
regulation. Indeed, the plan finds that these practices will be subject to case-by-case review under the plan’s new “Internet conduct” standard. That standard evaluates at least seven vaguely defined factors in
determining whether a practice is allowed. The plan makes clear that these practices are now on the chopping block, with those of mobile operators under special scrutiny. This means that consumers who use less data may end up subsidizing consumers who use more data. Moreover, the President’s plan goes  out of its way to say that sponsored-data plans and zero-rating programs, like T-Mobile’s Music Freedom offering, may violate the new standard for Internet conduct. Preventing companies from differentiating themselves from the competition by giving consumers a wide variety of options will mean less choice and less free data for consumers. If you like your current service plan, you should be able to keep your current service plan. The FCC shouldn’t take it away from you.

 

Third

, President Obama’s plan gives the FCC broad and unprecedented discretion to micromanage the Internet. The plan gives a Washington bureaucracy a blank check to decide how Internet service providers deploy and manage their networks, from the last mile all the way through the
Internet backbone. Take interconnection as just one example. The plan states that the FCC can determine when a broadband provider must establish physical interconnection points, where they must locate those points, how much they can charge for the provision of that infrastructure, and how they will route traffic
over those connections. That is anything but light touch regulation. And the plan extends the FCC’s interventionist gaze well beyond this part of the network. Small wonder that some pro-regulation activists are already deeming the FCC the “Department of the Internet.”

Fourth

, the President’s plan is a gift to trial lawyers. The plan allows class-action lawsuits—with attorneys’ fees—should any trial lawyer want to challenge an Internet service provider’s network management practices or rates. Indeed, the plan expressly declines to forbear from sections 206 and 207 of the Act, which authorize such private rights of action. And it adopts a theory of broadband subscriber access services—that is, services that broadband providers supply to edge providers—that would allow anyone online to file a complaint or go to court. The end result will be more litigation and less innovation.

Fifth

, the President’s plan makes clear that more utility-style regulation is coming. In discussing additional rate regulation, tariffs, last-mile unbundling, burdensome administrative filing requirements, accounting standards, and entry and exit regulation, the plan repeatedly states that it is only
forbearing at this time. The plan is quite clear about the limited duration of its forbearance determinations, stating that the FCC will revisit the forbearance determinations in the future and proceed in an incremental manner with respect to additional regulation. In other words, over time, expect regulation to ratchet up and forbearance to fade.

Sixth

, President Obama’s plan to regulate the Internet explicitly opens the door to billions of dollars in new taxes on broadband. The plan repeatedly states that it is only deferring a decision on new broadband taxes (such as Universal Service Fund fees and Telecommunications Relay Service fees,
among others)—not prohibiting them. And it takes pains to make clear that nothing in the draft is intended to foreclose future state or federal tax increases. Indeed, the plan engages in the same two-step we saw last year with respect to the E-Rate program: Lay the groundwork to increase taxes in the first order, and then raise them in the second. One independent estimate puts the price tag of these and other fees at $11 billion.
In the end, when you compare what the American public is being told about President Obama’s plan to regulate the Internet with the actual text of that plan, these and other discrepancies become apparent. That makes it all the more important for the FCC to let the American public see the plan before
the FCC makes it the law. We should be able to have an open, transparent debate about the President’s plan.”

Barack Obama is a liar. There is a long pattern of Obama lies. Representative Joe Wilson was right when he yelled out “lie” when Obama was speaking to Congress and the American people.

We need more Joe Wilsons in Congress.

This article will not address Obama’s long pattern of ties to crime and corruption in Chicago and Illinois, but of course lying and corruption go hand in hand. When I first began investigating Obama early in 2008, it was rapidly clear that Obama was steeped in lies and corruption. Here are some of the more prominent documented lies from Obama:

Obama lied on his IL bar application when he failed to list numerous traffic tickets.

Obama lied about his contact with Tony Rezko. FBI mole John Thomas revealed this during the Tony Rezko trial.

Obama lied about his ties to William Ayers.

Obama lied about his involvement with Acorn.

Obama lied about his unawareness of Jeremiah Wright’s racist, un American speeches.

In an article dated July 2, 2009, Forbes magazine exposes Obama as a liar.

“But when it comes to health care reform, with every passing day, Obama seems less God and more demagogue, uttering not transcendental truths, but bald-faced lies. Here are the top five lies that His Awesomeness has told–the first two for no reason other than to get elected and the next three to sell socialized medicine to a wary nation.”
“Lie One: No one will be compelled to buy coverage.

During the campaign, Obama insisted that he would not resort to an individual mandate to achieve universal coverage. In fact, he repeatedly ripped Hillary Clinton’s plan for proposing one. “To force people to buy coverage,” he insisted, “you’ve got to have a very harsh penalty.” What will this penalty be, he demanded? “Are you going to garnish their wages?” he asked Hillary in one debate.

Yet now, Obama is behaving as if he said never a hostile word about the mandate. Earlier this month, in a letter to Sens. Max Baucus, D-Mont., and Ted Kennedy, D-Mass., he blithely declared that he was all for “making every American responsible for having health insurance coverage, and making employers share in the cost.””
“Lie Two: No new taxes on employer benefits.

Obama took his Republican rival, Sen. John McCain, to the mat for suggesting that it might be better to remove the existing health care tax break that individuals get on their employer-sponsored coverage,”

“Yet now Obama is signaling his willingness to go along with a far worse scheme to tax employer-sponsored benefits to fund the $1.6 trillion or so it will cost to provide universal coverage. Contrary to Obama’s allegations, McCain’s plan did not ultimately entail a net tax increase because he intended to return to individuals whatever money was raised by scrapping the tax deduction. Not so with Obama. He apparently told Sen. Baucus that he would consider the senator’s plan for rolling back the tax exclusion that expensive, Cadillac-style employer-sponsored plans enjoy, in order to pay for universal coverage. But, unlike McCain, he has said nothing about putting offsetting deductions or credits in the hands of individuals.”
“Lie Three: Government can control rising health care costs better than the private sector.”

“But lower administrative costs do not necessarily mean greater efficiency. Indeed, the Congressional Budget Office analysis last year chastised Medicare’s lax attitude on this front. “The traditional fee-for-service Medicare program does relatively little to manage benefits, which tends to reduce its administrative costs but may raise its overall spending relative to a more tightly managed approach,” it noted on page 93.”
“Lie Four: A public plan won’t be a Trojan horse for a single-payer monopoly.

Obama has repeatedly claimed that forcing private plans to compete with a public plan will simply “keep them honest” and give patients more options–not lead to a full-blown, Canadian-style, single-payer monopoly. As I argued in my previous column, this is wishful thinking given that government programs such as Medicare have a history of controlling costs by underpaying providers, who make up the losses by charging private plans more.”

“But, as it turns out, it very much is his intention. Before he decided to run for office–and even during the initial days of his campaign–Obama repeatedly said that he was in favor of a single-payer system. What’s more, University of California, Berkeley Professor Jacob Hacker, who is a key influence on the Obama administration, is on tape explicitly boasting that a public plan is a means for creating a single-payer system. “It’s not a Trojan horse,” he quips, “it’s just right there.””
“Lie Five: Patients don’t have to fear rationing.

Obama has been insisting, including during his ABC Town Hall event last week, that the rationing patients would face under a government-run system wouldn’t be any more draconian than what they currently confront under private plans. This is complete nonsense.”

“By that token, Obama’s stimulus bill has set in motion rationing on a scale unimaginable in the land of the free. Indeed, the bill commits over $1 billion to conduct comparative effectiveness research that will evaluate the relative merits of various treatments. That in itself wouldn’t be so objectionable–if it weren’t for the fact that a board will then “direct financing” toward approved, standardized treatments. In short, doctors will find it much harder to prescribe newer or non-standard treatments not yet deemed effective by health care bureaucrats. This is exactly along the lines of the British system, where breast cancer patients were denied Herceptin, a new miracle drug, until enraged women fought back. Even the much-vilified managed care plans would appear to be a paragon of generosity in comparison with this.”

5.) My Grandmother Has Always Been A Christian – LIAR, she does her daily Salat prayers at 5am according to her own interviews. Not to mention, Christianity wouldn’t allow her to have been one of 14 wives to 1 man.

6.) My Name is African Swahili – LIAR, your name is Arabic and ‘Baraka’ (from which Barack came) means ‘blessed’ in that language. Hussein is also Arabic and so is Obama.

7.) I Never Practiced Islam – LIAR, you practiced it daily at school, where you were registered as a Muslim and kept that faith for 31 years,until your wife made you change, so you could run for office.

8.) My School In Indonesia Was Christian – LIAR, you were registered as Muslim there and got in trouble in Koranic Studies for making faces (check your own book).

9.) I Was Fluent In Indonesian – LIAR, not one teacher says you could speak the language.

10.) Because I Lived In Indonesia, I Have More Foreign Experience – LIAR, you were there from the ages of 6 to 10, and couldn’t even speak the language. What did you learn, how to study the Koran and watch cartoons.

11.) I Am Stronger On Foreign Affairs – LIAR, except for Africa (surprise) and the Middle East (bigger surprise), you have never been anywhere else on the planet and thus have NO experience with our closest allies.

12.) I Blame My Early Drug Use On Ethnic Confusion – LIAR, you were quite content in high school to be Barry Obama, no mention of Kenya and no mention of struggle to identify – your classmates said you were just fine.

13.)An Ebony Article Moved Me To Run For Office – LIAR, Ebony has yet to find the article you mention in your book. It doesn’t, and never did, exist.

14.) A Life Magazine Article Changed My Outlook On Life – LIAR, Life has yet to find the article you mention in your book. It doesn’t, and never did, exist.

15.) I Won’t Run On A National Ticket In ‘08 – LIAR, here you are, despite saying, live on TV, that you would not have enough experience by then, and you are all about having experience first.

16.) Present Votes Are Common In Illinois – LIAR, they are common for YOU, but not many others have 130 NO VOTES.

And of course the biggest lie, many of us believe, is Obama being eligible to be POTUS based on being a natural born citizen. Obama signed a certification on the Arizona Presidential Preference Election Candidate Nomination Paper, form A.R.S. 16-242, that he is a natural born citizen. God willing, we will get a definitive answer on this soon.

Barack Obama has begun distancing himself from IL Governor Rod Blagojevech
now and will “throw him under the bus” after Blagojevich’s arrest.
However, Obama and Blagojevich have strong ties going back for years
including Obama endorsing Blagojevich.

Obama and Blagojevich ties to Chicago and IL crime and corruption

ABC News has an article and video that catches Obama lying again regarding
his contact with Rod Blagojevich:

“Questions Arise About the Obama/Blagojevich Relationship
December 09, 2008 3:37 PM

“Obviously like the rest of the people of Illinois I am saddened and sobered by the news that came out of the US attorney’s office today,” said President-elect Obama this afternoon in Chicago, speaking of the criminal complaint against Democratic Gov. Rod Blagojevich for corruption. “But as this is a ongoing investigation involving the governor I don’t think it would be appropriate for me to comment on the issue at this time.”

Asked what contact he’d had with the governor’s office about his replacement in the Senate, President-elect Obama today said “I had no contact with the governor or his office and so we were not, I was not aware of what was happening.”

But on November 23, 2008, his senior adviser David Axelrod appeared on Fox News Chicago and said something quite different.

While insisting that the President-elect had not expressed a favorite to replace him, and his inclination was to avoid being a “kingmaker,” Axelrod said, “I know he’s talked to the governor and there are a whole range of names many of which have surfaced, and I think he has a fondness for a lot of them.””

“These two entities — Fannie Mae and Freddie Mac — are not facing any kind of financial crisis, the more people exaggerate these problems, the more pressure there is on these companies, the less we will see in terms of affordable housing.

If Congress does not act, American taxpayers will continue to be exposed to the enormous risk that Fannie Mae and Freddie Mac pose to the housing market, the overall financial system, and the economy as a whole.”

 Obama and his democrat buddies never let the truth get in the way
of a good story. Never has this been more true than now in the face
of a financial crisis in this country. A financial crisis Obama and
his party created. What do Obama and Barney Frank have in common
besides being Democrats. They both were listed in the top 25
recipients of campaign contributions from Fannie Mae and Freddie Mac
and they both are hypocrites. Obama is number 3 on the the list
and Barney Frank is 16. Obama, the candidate of change, was in
bed with Fannie Mae and Freddie Mac yet he criticizes John McCain,
who along with George Bush, tried to fix the problem.

This is stunningly naive. Recent statements by Barney Frank (D., Mass.), the chairman of the House Financial Services Committee, and Chuck Schumer (D., N.Y.), a powerful member of the Senate Banking Committee, make clear that Congress will never let them be privatized, broken up, slimmed down, nationalized or any of the other options hopeful reformers are putting forth today. Fannie and Freddie in their current form are just what Congress wants: an inexhaustible source of campaign contributions and funds for favored groups.

from Fannie Mae and Freddie Mac that have just been bailed out

John Kerry, who has about the least amount of credibility of anyone who has ever run for office, has started a new website, TruthFightsBack.com. Here is the statement from the Kerry site:

This effort to beat back rightwing smears and have an election based on reality and truth is completely in your hands. From the reporting and debunking of smears to the spreading of the truth, we are depending on you. Jerome Corsi, PHD, has written a new book, “The Obama Nation.” Mr. Corsi, who coauthored “Unfit for Command,” a book about the reputation of John Kerry and the many lies he told, has exposed Obama for the deceitful fraud he is as well as his ties to corruption and left wing extremists. Anyone who has questioned Obama has received personal attacks and Jerome Corsi is no exception.

I have a copy of “Unfit for Command” as well as “The Obama Nation.” On the introduction page of “Unfit for Command” is the following quote. It speaks volumes about John Kerry and his credibility:

“I do not believe John Kerry is fit to be commander in chief of the armed forces of the United States. This is not a political issue. It is a matter of his judgement, truthfulness, reliability, loyalty, and trust–all absolute tenets of command.”
